I, the undersigned, do hereby waive and release the Carl Junction Bluegrass festival committee, volunteers, 5k run, Carl Junction Chamber of Commerce, their employees, and Runaround Racing from any and all liabilities or claims arising from my participation in this race. I further agree that any volunteers, sponsors, municipal or county officials assisting in the race day event shall not be liable for any injury or damages that I may sustain as a result of my participation in this race. I fully assume the risk of any and all such injuries that may occur. On behalf of myself and my heirs, executors, administrators and assigns, I do hereby fully and forever waive, release and discharge the entities and individuals listed above from any and all claims, liabilities, obligations, promises, agreements, controversies, damages, losses, actions, causes of action, suits, rights, demands, judgments, amounts paid in settlement, costs, debts and expenses of any nature whatsoever (including, but not limited to, attorney’s fees and costs) related in any manner to by participation in the race. (collectively, “claims(s)”), which I have or may have whether the claim(s) arise under contract, statute, common law or otherwise, whether the same be at law or in equity, and further including but not limited to, any claim for negligence, or any other tort, breach, infraction, or wrong, be intentional, negligent or otherwise. This release covers any and all present or future claims. I further grant my permission for Carl Junction Bluegrass Festival Committee to use any race day photos or videos containing my image or any other records of this race for any legitimate marketing or advertising purpose. I further understand that support services and traffic control will only be provided during the scheduled race time. Pedestrian rules apply before and after the official race time. I attest that I am physically fit and have sufficiently trained for this race. My signature below evidences this understanding and agreement. I acknowledge that I have read the foregoing in its entirety and that I fully understand the possible risks and liabilities involved and have decided to participate in this race.
