This registration must be signed by the participant, or by the participant's parent or legal guardian. Any registration submitted in violation of this requirement is void. I understand that my participation in this event is potentially hazardous, and that I should not enter or participate in it unless I am medically able and properly trained to do so. I understand that participation in this event may result in my injury or death, and in loss or damage to property, and I voluntarily accept all risks associated with my participation in this event. Intending to be legally bound for myself and my heirs, successors, executors, administrators, representatives, assigns, and anyone else who might assert any claim on my behalf, and I hereby waive, release, discharge, and covenant not to sue the Run for the Melon, 5K/10K Walk/Run Race director and/or support staff, the City of Vining and elected officials, the Watermelon Day Committee, including all individuals and entities associated with the Committee, including but not limited to their owners, officers, directors, employees, volunteers, contractors, subcontractors, officials, and sponsors, together with their agents, assigns, and anyone acting on their behalf, of and from any and all claims, demands, injuries, actions, causes of action, and liabilities, including claims of ordinary negligence, for death, injury, or property loss or damage of any kind or nature arising out of or in connection with my participation in this event (collectively “claims”). I agree that this waiver extends to all claims of whatever kind or nature, foreseen or unforeseen, known or unknown. I also grant permission to the Run for the Melon and/or any agents acting on its behalf to take and use any broadcasts, telecasts, photographs, videotapes, motion pictures, voice recordings, and any other images or recordings of my participation in this event for any legitimate purpose, without compensation to me. I agree that the Run for the Melon, 5K/10K Walk/Run Race and/or its agents may use my name in association with any such purpose, and that all such broadcasts, telecasts, photographs, videotapes, motion pictures, voice recordings, and other recordings, and all programs, publications, and other products using them, are and shall remain the property of the Run for the Melon, 5K/10K Walk/Run Race. I understand that this event is held on public streets and related facilities, and that my health and safety may be affected by the condition of the streets and related facilities, the actions of other participants, volunteers, race officials, members of the public, and others, the weather (including but not limited to heat, cold, storms, ice, snow, water, wind, precipitation, and humidity), traffic, and other factors. I understand that if I choose to wear headphones, earbuds, or any other head or ear appliance or device, that use may constitute negligence on my part, and may nullify medical or liability insurance coverage that might otherwise be available to me, in the event of an otherwise coverable occurrence arising out of or in connection with my participation in this event. I understand and agree that my registration is non-refundable, even if this event is postponed or canceled, and that my registration and number are not transferable. If I am registering a child under the age of 18, I represent and warrant that I am the parent or legal guardian of that child and have the legal authority to enter into this agreement on his or her behalf. I agree that the terms of this agreement shall apply fully to that child and to his or her parents, guardians, heirs, successors, executors, administrators, representatives, assigns, and anyone else who might assert any claim on his or her behalf. If any claim is made by or on behalf of the child or his or her parents, guardians, heirs, successors, executors, administrators, representatives, assigns, or anyone else who might assert any claim on his or her behalf, I agree to indemnify and hold harmless the Run for the Melon, 5K and/or 10K Walk/Run, including staff and volunteers, the City of Vining, the Watermelon Day Committee, and all individuals and entities associated with them, against any and all such claims. I have read the foregoing, and voluntarily agree to it by my signature below.
