By completing this registration, you agree to and fully understand the following: Running is a potentially hazardous activity and I should not enter and run/walk unless I am medically able and properly trained. I agree to abide by any decision of race officials relative to my ability to safely compete in this race. I take responsibility for my own actions, and I assume all risks associated with this race, including, but not limited to: falls, injuries, death, damage to property, contact with other participants, effects of traffic, etc. I, for my heirs, my assigns, and myself, waive and release the Seacoast Half Marathon organizing committee, the City of Portsmouth, the Towns of Rye and New Castle, Haven, CACRC, Runner’s Alley, all sponsors and volunteers of this race, and the State of N.H. from any and all claims and liabilities of any kind whatsoever arising from your voluntary participation in this event, regardless of whether such liability results from carelessness or negligence of the persons/organizations named in this waiver.
The Town of Rye (“Town”) has been asked to allow a road race on Town roads on Nov. 10, 2019, subject to numerous conditions which include participants executing liability waivers in favor of the Town. Caution: This Release and Waiver of liability prevents you from bringing a claim to recover damages against the Releasees even if the Releasees were negligent and caused your injuries and damages. In consideration of being permitted to participate in the road race, the undersigned: 1. Hereby releases, waives, discharges and covenants not to sue the Town, its officials, employees attorneys, agents, representatives, volunteers and insurers (hereinafter “Releasees”) from all liability to the undersigned, and his/her representatives, heirs, and successors in interest (hereinafter “undersigned”) for any and all loss or damage, and any claim or demands therefore on account of injury to the person or property of the undersigned, whether caused by the negligence of the Releasees or otherwise, while on, about or using Town premises in relation to the road race, or while participating in the road race. Undersigned also agrees to defend, indemnify, save and hold harmless the Releasees from any loss, injury, liability, damage or cost they may incur due to the activity described above whether caused by the negligence of the Releasees or otherwise. 2. Hereby assumes full responsibility for and risk of bodily injury or property damage, including but not limited to death, paralysis, brain injury, heart attack, stroke, aneurysm, broken bones, torn tendons or ligaments, torn muscles, spinal injury, damage to organs, disease, infection, heat exhaustion and heat stroke, emotional distress, psychological injury and any other physical or emotional injury, medical or psychiatric condition or complication of any kind whatsoever, due to any cause, including the negligence of Releasees or otherwise, while on, about or using Town premises in relation to the road race, or while participating in the road race. 3. Hereby represents and warrants: (a) that he/she acknowledges the road race and related activities are dangerous and therefore involves the risk of serious bodily, emotional and psychiatric injury, death and property damage; (b) that some of the risks of harm include, but are not limited to, physical activity, equipment failure, equipment maintenance or lack thereof, equipment defects, slippery surfaces, obstacles and conditions which might cause trip and falls, pre-existing health problems, carelessness and negligence of Releasees, inadequate or negligent supervision, instruction, assistance or oversight, structural failures, design defects, impeded access, the dangerous actions of Releasees, other participants and/or the public, the elements and weather, collisions with people, objects, vehicles and any other forms of transportation, motor vehicles of all kinds, pedestrians, runners, skateboarders, rollerbladers, bicycles, motorcycles, mopeds, scooters, traffic, wild and domestic animals, debris on or about the road, uneven terrain, damaged roads, lack of security, inadequate emergency response time, inadequate/incorrect medical response, and any other risk of harm whatsoever that one might encounter while on, about or using Town premises in relation to a road race, or while participating in the road race; (c) that he/she has read this Release of Liability carefully and had an opportunity to review it with legal counsel; and (d) that he/she is in good health and has no physical condition that prevents them from engaging in fitness or exercise activities, including but not limited to participating in a road race.
You grant the Seacoast Half Marathon permission to use your photo or likeness to help promote the race. Rollerblades, skateboards, strollers and pets are not allowed. RACE REGISTRATIONS ARE NOT TRANSFERABLE AND ENTRY FEES ARE NON-REFUNDABLE.
