免責聲明
茲鑒於本人申請參加2019年XTERRA台灣越野三項比賽與越野跑比賽(包括但不限於參賽以及參加任何賽前與賽後活動與社交活動)【下合稱為「本賽事」】 ，與/或本人被允許主持、觀察、工作或以任何方式參加本賽事或其活動；本人茲基於自由意志同意，並代表本人、本人代理人、受讓人與繼承人，聲明並同意受以下條款拘束：
(1) 本人茲同意免除斯恩股份有限公司(XTERRA TAIWAN) (賽事舉辦方，下稱「斯恩公司」)；舉辦本賽事或部分賽事之所有市、縣或地區；所有賽事協辦方(包括但不限於展通虹策略整合行銷股份有限公司)、贊助商、廣告商、官方人員、志願義工與獨立承包商；用於舉辦本賽事或於本賽事時所使用的財產之所有人與承租人；以及前述任何人員之高級職員、董事、股東、合夥人、僱員、成員與代理人【以下合稱「被豁免方」】，針對直接或間接所致本人之傷害或財產損害或死亡(無論是否由被豁免方之任何行為或不作為所導致者，包括但不限於因被豁免方之疏失所致、或於本人以任何形式參與、主持、觀察、工作或以任何方式參與本賽事或其活動之過程中所發生者)之一切責任，本人並同意不對被豁免方提出任何訴訟，且本人並同意為被豁免方辯護、賠償、使被豁免方免於因本人、本人代理人、繼承人與受讓人對被豁免方主張任何索賠與責任(包括律師費用)；
(2) 本人瞭解參加本賽事可能為一項危險活動，有嚴重人身傷害、死亡或財產損失之風險，且本人對於因被豁免方之疏失、或其他因本聲明書第1條所述之任何事件所導致或與之有關的任何方式所造成之人身傷害、死亡與財產損失之風險，本人承諾承擔全部之責任；
(3) 本人同意遵守本賽事及其官員單位之所有規則、規定與指示;
(4) 本人身體健康、有足夠能力參加本賽事，且並無任何醫療健康因素使本人不應參加本賽事；
(5) 若本人於本賽事期間生病不適、或受傷、或發生意外、或其他經賽事官方單位認為必要或適當之情形，本人同意接受醫療救治；本人並同意本賽事主辦方、協辦方、工作人員、醫務人員、賽事總監或保安基於安全與/或健康上合理理由，有權要求本人退出本賽事與其活動，並取消本人之參加資格；
(6) 本人同意斯恩公司有權收集、儲存及使用本人於報名表中所填報之個人資料用於本賽事與相關活動(包括但不限於籌備、推廣或宣傳該活動)；本人同意在斯恩公司認為必要之任何目的內，在任何與所有之賽事宣傳資料、錄影帶、電視廣播與宣傳活動中，免費及無限制地使用本人之姓名、聲音、照片與個人資料，包括但不限於商業使用、發放予本賽事被豁免方用於本賽事與相關之目的，且本人拋棄任何由於使用本人姓名或肖像或任何個人資料而可能享有之任何請求之權利；
(7) 本人確認在參賽時提供了準確的個人信息;本人並同意，提供正確有效之身分證/護照，以驗證本人提供給被豁免方之個人資訊，對由因不正確或無效之個人資訊所造成之結果，本人同意承擔全部責任；
(8) 本人茲已詳細閱讀、充分理解並出於自由意志而簽署本聲明條款。
本人特此證明，本人已滿十八歲或以上，且本人已閱讀本聲明條款內容，並充分瞭解其內容。
未滿18歲者，父母或法定監護人必須簽署上述免責聲明並完成以下部分。
本人為____________（「子女」）之父母或法定監護人，並代表本人子女簽署上述免責聲明。 本人已閱讀並理解本免責聲明。鑒於允許本人子女參予本賽事，本人同意本免責聲明的條款對本人、本人子女、我們之代理人、繼承人與受讓人均有約束力。
本人茲免除被豁免方有關因本人子女參加本賽事或其活動，所直接或間接致本人或本人子女遭受之傷害或財產損害或死亡之一切責任，無論是否出於被豁免方之疏失或其他原因所導致，本人並同意不對被豁免方提出任何訴訟，且同意為被豁免方辯護、賠償、使被豁免方免於因本人或本人子女對被豁免方主張任何索賠與責任(包括律師費用)。

WARNING
This is a legal document that affects your rights. If you are uncertain about any terms in this document, you should consult independent legal advice before signing. If another person has entered your application in the Event and you have also participated in the Events, that person is assumed to be your agent and that person has accepted on your behalf all the terms and conditions set out within the online registration system of the Events. Furthermore, the Event organizer may still require you to sign this agreement on the date of the event even though you have entered online.
WAIVER AND RELEASE AGREEMENT
In consideration of the acceptance of my application to participate in the 2019 XTERRA Taiwan off-road triathlon and trail run events including without limitation, competing in the race(s) and participating in any all pre and post race activities and social events (collectively, the "Event"), and/or my being permitted to officiate, observe, work for or in any manner participate in the Event or its staging, and intending to be legally bound hereby, I hereby freely agree, represent and acknowledge, for myself, my personal representatives, assigns and heirs that:
(1) I HEREBY RELEASE AND PROMISE NOT TO SUE, AND SHALL DEFEND, INDEMNIFY AND HOLD HARMLESS, CIAN CO., LTD. (XTERRA TAIWAN)(the Event organizer, hereinafter referred to as "CIAN"); all cities, counties or localities in which the Event or segments of the Event are held; all Event co-organizer (including but not limited to RAINBOW WINGS I.M.C CO., LTD), sponsors, advertisers, officials, volunteers and independent contractors; owners and lessees of property used to conduct or used in conjunction with the Event; and the officers, directors, shareholders, partners, employees, members and agents of any of the above (the "Releasees"); FROM EVERY CLAIM AND ANY LIABILITY that I, my personal representatives, heirs and assigns may allege against the Releasees, including attorney's fees, as a direct or indirect result of injury to me or my property or resulting in my death, whether or not caused by any act or omission of Releasees, including but not limited to the negligence of Releasees or otherwise while I am in any way competing in, officiating, observing, working for, or in any manner participating in the Event or its staging;
(2) I acknowledge that participating in the Event can be a dangerous activity that involves risks of serious bodily injury, death or property damage and I HEREBY ASSUME FULL RESPONSIBILITY FOR RISK OF BODILY INJURY, DEATH AND PROPERTY DAMAGE due to the negligence of Releasees or otherwise arising out of or in any way relating to any of the events referred to in item 1 hereof;
(3) I will comply with all rules, regulations and instructions of the Event and its officials;
(4) I am physically fit, have sufficiently trained for the Event, and there is no medical reason why I should not participate in the Event;
(5) I CONSENT TO RECEIVE MEDICAL TREATMENT in the event that I become ill, I am injured or I am involved in an accident during the Event or as otherwise deemed necessary or advisable by Event officials; I FURTHER CONSENT TO RETIRE AND LEAVE THE EVENTS OR ITS STAGING immediately if requested by Event organizer, Event co-organizer, Event official, medical staff, Event director or security staff based on reasonable safety and/or health reason.
(6) I CONSENT TO CIAN TO COLLECT, STORE AND USE MY PERSONAL DATA as provided by me in the Entry Form for the purpose of or in connection with the Event (including but not limited to organization, promotion, and publicity of the Event) ; and I CONSENT TO THE FREE AND UNRESTRICTED USE OF MY NAME, VOICE, PICTURE AND PERSONAL DATA in any and all Event promotional materials, videotapes, telecasts, and promotions for any purposes deemed necessary by CIAN, including but not limited to commercial use and passing to the Releasees for the purpose of or in connection with the Events, and I waive all right to any claims to which I may otherwise be entitled as a result of the use of my name or likeness or any other personal data;
(7) I confirm to participate in the event with my accurate personal information; and I consent to provide correct and valid ID/passport to verify my personal details to the Releasees and agree to take full responsibility of any consequences resulted from incorrect or invalid personal details;
(8) I HAVE CAREFULLY READ, UNDERSTAND AND VOLUNTARILY SIGNED THIS AGREEMENT.
I HEREBY AFFIRM THAT I AM EIGHTEEN (18) YEARS OF AGE OR OLDER, I HAVE READ THIS DOCUMENT, AND I UNDERSTAND ITS CONTENTS.
For persons under 18 years of age, a parent or legal guardian must sign the above Waiver and Release and complete the following section.
I am the parent or natural guardian of _________________________________ ("Child") and have executed the foregoing Waiver and Release Agreement for and on behalf of my Child. I HAVE READ AND UNDERSTAND THIS WAIVER AND RELEASE AGREEMENT. In consideration of allowing my Child to participate in the Event, I agree that THE TERMS OF THIS WAIVER AND RELEASE AGREEMENT SHALL BIND ME, MY CHILD, our personal representatives, heirs and assigns. I HEREBY RELEASE AND PROMISE NOT TO SUE, AND SHALL DEFEND, INDEMNIFY AND HOLD HARMLESS, THE RELEASEES FROM EVERY CLAIM AND ANY LIABILITY that I or my Child may allege against the Releasees, including attorney fees, as a direct or indirect result of injury to me or my child, or my or my Child's property, or resulting in my or my Child's death, because of my Child's participation in the Event or its staging, WHETHER CAUSED BY THE NEGLIGENCE OF THE RELEASEES or otherwise.
