READ CAREFULLY – THIS IS A WAIVER AND RELEASE OF LIABILITY
I and/or my minor child(ren) desire(s) to voluntarily participate in physical activities and/or a performance in conjunction with a 5K walk/run at the RP Funding Center (the “Event”). I and/or my minor child(ren) have/has no existing medical condition and I have no knowledge of any condition in my and/or my minor child(ren)’s medical history that would prevent me/us from participating fully in physical activity in conjunction with the Event. I hereby certify that I and/or my minor child(ren) am/are in good physical condition and am/are able to participate in the Event without causing physical injury to myself/ourselves and others.
In consideration for allowing me and/or my minor child(ren) to participate in the Event, I hereby agree to release, waive, covenant not to sue, and forever discharge Central Florida Basketball Partners, LLC, NBA G League and its member teams, NBA Development League, LLC, NBA Development League, Inc, Orlando Magic, Ltd, Orlando Events Center Enterprises, LLC, Orlando Magic Youth Foundation, Inc., the National Basketball Association and its Member Teams, NBA Media Ventures LLC, NBA Properties, Inc, NBA Entertainment, Inc., the City of Lakeland, the City of Orlando, and each of their respective officers, employees, agents, successors, parents, affiliates, subsidiaries, sponsors, advertising and merchandising agencies, licensees, and assigns (collectively, the “Releasees”) from all liability to me, my personal representatives, heirs, assigns and next of kin for any and all injury, damages, accident, or death which may occur to me and/or my minor child(ren) during my or my child(ren)’s participation in the Event, including any liability which is attributable to the negligence of the Releasees, or otherwise.
Further, I hereby consent and grant permission to Central Florida Basketball Partners, LLC, NBA G League and its member teams, NBA Development League, LLC, NBA Development League, Inc, Orlando Magic, Ltd., Orlando Events Center Enterprises, LLC, Orlando Magic Youth Foundation, Inc., the National Basketball Association and its Member Teams, NBA Media Ventures LLC, NBA Properties, Inc., NBA Entertainment, Inc., and each of their respective officers, employees, agents, successors, parents, affiliates, subsidiaries, sponsors, advertising and merchandising agencies, licensees, and assigns (hereinafter the “Magic”) to use my and/or my child(ren)’s name(s), photograph(s) and/or video(s) of me and/or those of my minor child(ren), worldwide and in perpetuity, for any purpose, by any means and in any medium, whether now known or hereinafter developed. I understand that I shall not have any right to review or approve of any material within which my photograph and/or video may appear and I understand that the Magic may use such photographs or video with or without associating names thereto. I further waive any claim for compensation of any kind for the Magic’s use and/or publication of photographs and/or video of me and/or those of my minor child(ren) (if applicable). I hereby fully and forever discharge and release the Magic from any claim for damages of any kind (including, but not limited to, invasion of privacy; defamation; false light or misappropriation of name, likeness or image) arising out of the use or publication of photographs and/or video of me and/or those of my minor child(ren) (if applicable) by the Magic, and covenant and agree not to sue or otherwise initiate legal proceedings against the Magic for such use or publication on my own behalf or on behalf of my minor child(ren). All grants of permission and consent, and all covenants, agreements, and understandings contained herein are irrevocable. I acknowledge and represent that I am over the age of 18, that I have read this entire document, that I understand its terms and provisions, and that I have signed it knowingly and voluntarily on behalf of myself and/or my minor child(ren) (if applicable).
NOTICE TO THE MINOR CHILD(REN)’S NATURAL GUARDIAN
READ THIS FORM COMPLETELY AND CAREFULLY. YOU ARE AGREEING TO LET YOUR MINOR CHILD(REN) ENGAGE IN A POTENTIALLY DANGEROUS ACTIVITY. YOU ARE AGREEING THAT, EVEN IF THE RELEASEES (AS DEFINED ABOVE) USE REASONABLE CARE IN PROVIDING THIS ACTIVITY, THERE IS A CHANCE YOUR CHILD(REN) MAY BE SERIOUSLY INJURED OR KILLED BY PARTICIPATING IN THIS ACTIVITY BECAUSE THERE ARE CERTAIN DANGERS INHERENT IN THE ACTIVITY WHICH CANNOT BE AVOIDED OR ELIMINATED. BY SIGNING THIS FORM YOU ARE GIVING UP YOUR CHILD(REN)’S RIGHT AND YOUR RIGHT TO RECOVER FROM THE RELEASEES IN A LAWSUIT FOR ANY PERSONAL INJURY, INCLUDING DEATH, TO YOUR CHILD(REN) OR ANY PROPERTY DAMAGE THAT RESULTS FROM THE RISKS THAT ARE A NATURAL PART OF THE ACTIVITY. YOU HAVE THE RIGHT TO REFUSE TO SIGN THIS FORM, AND THE RELEASEES HAVE THE RIGHT TO REFUSE TO LET YOUR CHILD(REN) PARTICIPATE IF YOU DO NOT SIGN THIS FORM.
