RELEASE OF CLAIMS, WAIVER OF LIABILITY, ASSUMPTION OF RISK AND INDEMNIFICATION AGREEMENT
WARNING, THIS AGREEMENT IS LEGALLY BINDING.  BY SIGNING THIS AGREEMENT, YOU GIVE UP YOUR RIGHT TO RECOVER COMPENSATION THROUGH THE COURTS, ARBITRATION OR OTHERWISE, FOR ANY PERSONAL INJURIES OR DAMAGE TO YOU, YOUR PROPERTY OR FOR YOUR DEATH, ARISING OUT YOUR PARTICIPATION IN THE 2018 MOMBOSS 5K HOSTED BY COVEY EVENTS LLC AT THE HUTTON HOUSE IN MEDICINE LAKE, MN (COLLECTIVELY THE “RELEASED PARTIES" INCLUDING THE HUTTON HOUSE, THE CITY OF MEDICINE LAKE, THREE RIVERS PARK DISTRICT AND HENNEPIN COUNTY).  BY SIGNING THIS AGREEMENT YOU ARE RELEASING THE RELEASED PARTIES OR ANY PERSON ASSOCIATED WITH THE RELEASED PARTIES FOR ANY CLAIMS YOU MAY HAVE AGAINST IT REGARDING YOUR STAY AT RELEASED PARTIES PROPERTY.  THIS AGREEMENT IS BINDING ON YOU, YOUR HEIRS, PERSONAL REPRESENTATIVES, EXECUTORS, SUCCESSORS AND ASSIGNS.  THIS AGREEMENT ALSO REQUIRES YOU TO INDEMNIFY, DEFEND AND HOLD HARMLESS THE RELEASED PARTIES.  YOU MAY NOT PARTICIPATE IN THE RACE WITHOUT SIGNING THIS AGREEMENT.
 
ASSUMPTION AND ACKNOWLEDGMENT OF RISK
I, the undersigned, acknowledge and agree that participating in the Race has inherent risks, including permanent injury or death.  I am aware of the risks associated with the Race and I fully and voluntary assume complete responsibility for these risks and for the injuries that may occur as a result of these risks, even if injuries occur in a manner that is not perceivable at the time I sign this Agreement.  I realize that by voluntarily assuming the risks involved, I will be solely responsible for any loss or damage I sustain, including personal injuries to me, damage to my property or damage arising out of my death.  I understand that this event is held on public streets and related facilities and that my health and safety may be affected by the condition of the streets and related facilities, the actions of other participants, volunteers, Race officials, members of the public and others, the weather, traffic and other factors. 

RELEASE AND PROMISE NOT TO SUE 
In consideration of my use of the facilities, equipment and property of Released Parties, I hereby agree to release from all liability, discharge and promise not to sue the Released Parties from all damage or loss, whether or not created by the Released Parties’ negligence, whether active or passive.  This Waiver and Release does not include any damage or loss due to any acts that are intentional, willful or wanton misconduct by the Released Parties or its representatives.  This Agreement releases the aforementioned persons from any liability to me, my heirs, personal representatives, executors, successors or assigns for any losses or damages or claims or demands arising out of my personal injury, or damage to my property or from my death.  If any provision of this Agreement is held invalid, the invalidity shall not affect other provisions of the Agreement which can be given effect without the invalid provisions, and to this end the provisions of this Agreement are to be severable.   
 
USE OF IMAGES 
I grant permission to the Released Parties to use photographs, video, voice recordings or other images of the Race that may include me without further compensation to me and the same shall remain the property of the Released Parties.
 
INDEMNIFICATION AGREEMENT 
I agree to indemnify, defend and hold harmless the persons released and discharged by me from any loss, liability, damages or costs that may incur due to the presence of any claims or actions by me, my personal representatives, executors, heirs, successors or assigns arising out of my participation in the Race.  
 
I HAVE READ THIS AGREEMENT, I UNDERSTAND IT, AND I AGREE TO BE BOUND BY IT.  NO ORAL REPRESENTATIONS OR STATEMENTS OR INDUCEMENTS HAVE BEEN MADE TO ME THAT CHANGE, ALTER OR MODIFY ANYTHING WITHIN THIS AGREEMENT
