By registering for and participating in the Tulane University Prevention Research Center 5K Run/Walk (hereafter “5K”), I understand, acknowledge, and confirm the following: Participating in a road race is a potentially hazardous activity.  I am medically able to perform this event and am in good health. Possible risks of participating in a road race include, but are not limited to uneven terrain; falling and physical injury, including but not limited to scrapes, bruises, cuts, broken bones, and concussion; contact with other participants; effects of the weather, including but not limited to rain, high heat, and humidity; traffic; unmarked obstacles; potholes; varying visibility; and other obstacles and hazards. All such risks are assumed by me. I understand the description above of these risks is not complete and that other unknown or unanticipated risks may result in property loss or damage, bodily injury, or death. I agree to assume responsibility for the inherent risks both identified herein and not specifically identified or readily foreseeable at this time. My participation in the 5K is purely voluntary and I elect to participate in spite of and with full knowledge of all inherent risks and all other risks. THROUGH MY REGISTRATION, I PERSONALLY, FREELY, KNOWINGLY, AND EXPRESSLY ASSUME AND ACCEPT ANY AND ALL RISKS OF INJURY, DEATH, PROPERTY LOSS, AND ALL OTHER POSSIBLE LOSSES. I agree to hold harmless the Administrators of the Tulane Educational Fund d/b/a “Tulane University,” its trustees, officers, employees, agents, representatives, instructors, and volunteers (hereafter “Tulane and affiliates”) from any and all liability, actions, causes of action, damages, losses, injuries, debts, claims, or demands of any kind and nature whatsoever which may arise by or in connection with my participation in the 5K. I further agree to release, acquit, and covenant not to sue Tulane and affiliates for all actions, causes of action claims or damages, damages in law or remedies in equity of whatever kind. I give Tulane and affiliates the right to photograph, film, and/or record my participation in the 5K. I give Tulane and affiliates the sole and exclusive right and permission to copyright, use, reuse, re-record, duplicate, sell, exhibit, distribute, and broadcast such video recordings, audio recordings, and photographs of me for any purpose whatsoever and through any type of media throughout the world. As a result, I relinquish all rights to such recordings and photographs. I release, discharge, and agree to hold harmless Tulane and affiliates, in whole or in part, from and against any liability as a result of any edits, distortion, blurring, or alteration, optical illusion, or use in composite form, either inten­tionally or otherwise, that may occur or be produced in the taking, processing or reproduction of the finished product, its publication, distribution, or broadcast of the same even should the same subject me to ridicule, scandal, reproach, scorn, or indignity. The terms hereof shall serve as a release and assumption of risk for myself, my heirs, estate, executor, administrator, assignees and for all members of my family.
