17th Annual Best Buy Fun Run   
 
In consideration of my participation in the United Way Run/Walk on September 21st, 2017 ("Race"), I agree to the following: I acknowledge that the Race requires physical exertion and is a potentially hazardous activity. I warrant and represent that I have no physical limitations that would prohibit my participation. I acknowledge there may be traffic on the Race route and assume the risk of running in traffic as well as any other risks associated with running in the Race, including but not limited to falls, contact with other participants, the effects of weather, including high heat and/or humidity, and the conditions of the roads and/or trails. I agree to accept any and all financial obligations incurred as a result of any medical assistance and related expenses provided in connection with any injuries arising out of my participation in the Race. On behalf of myself, my heirs, executors, administers or anyone else who might claim on my behalf, I covenant that (i) I will not sue, and hereby waive, release, and discharge Best Buy Col, Inc., its subsidiaries and affiliates ("Best Buy") and any other organization associated with the race (including Hennepin County or the City of Richfield), their parent entities subsidiaries, affiliates, advertising and promotion agencies, and each of their respective officers, directors, employees, representatives, agents, or assigns (collectively, "Releases") from any claims or liability for any injuries, losses or damages of any kind to persons, including death, or property, foreseen or unforeseen resulting in whole or in part, directly or indirectly, from my participation in the Race; and (ii) I will indemnify and hold the Releases harmless from and against all such claims and liability. I give my consent to Best Buy and those acting under its authority to use my name, photograph, voice and/or likeness, without compensation, unless prohibited by law, in any and all advertising and promotional materials relating to the Race in all media now known or hereafter discovered, without notice, review or approval. I acknowledge that the Race is not open to the general public. I warrant and represent that (i) I am at least 18 years of age, or if not of legal age, have arranged for my parent/legal guardian to execute this Release; (ii) I have every right to contract in my own name, or if being signed by my parent/legal guardian, my parent/legal guardian has every right to contract on my behalf without obtaining the consent or approval of any other party; and (iii) I have or my parent/legal guardian has read this Release prior to signing it and fully understand the contents, effect and legal impact of this Release. IMPORTANT: IF PARTICIPANT IS UNDER THE AGE OF 18, HIS/HER PARENT OR LEGAL GUARDIAN MUST SIGN THIS RELEASE INSTEAD OF THE MINOR.
