Crusher Race LLC Participant Agreement, Release and Assumption of Risk

In consideration for being allowed to participate in The Crusher 5K, a 5k mud run featuring military style obstacles and fitness challenges; The Crusher 10K, a 10k mud run featuring military style obstacles and fitness challenges; The Colossal Crusher, which includes a series of fitness challenges, a 10k mud run featuring military style obstacles, and additional physical challenges,; The Kids Crusher a 1 mile mud run and obstacle course, collectively known as “The Crusher Race” and of the services of (1) Crusher Race LLC, their agents, owners, officers, affiliates, volunteers, participants, employees, and all other persons or entities acting in any capacity on their behalf (hereinafter collectively referred to as “CRLLC”), (2) the owner of the real property on which The Crusher Race is hosted or occurs including, but not limited to, Brookdale Farms (3) any independent contractors or personnel involved in preparing or conducting The Crusher Race including, but not limited to Big River Race Management, Brookdale Farms LLC, I hereby agree to release, indemnify, and discharge CRLLC, on behalf of myself, my spouse, my children, my parents, my heirs, assigns, personal representative and estate as follows:

1)       I understand that my participation in The Crusher Race entails known and unanticipated risks that could result in physical or emotional injury, paralysis, death, or damage to me, to property, or to third parties. Some of the possible injuries and bodily harm which can occur through attendance and participation are include herein but are not limited to: strains, sprains, pulls, tears, cramps, infections, rope burns, rashes, vomiting, bruises, contusions, wounds, insect bites, dislocations, blisters, nosebleeds, broken bones, fractures, chocking, respiratory or heart failure, heat exhaustion, heat stroke, nerve damage, shock, paralysis, concussion, ingestion of water or mud, drowning and death. I hereby acknowledge that my decision to participate and attend The Crusher Race is voluntary and made with full knowledge of the risks and hazards connected therewith. This risk includes the negligence of CRLLC, of other participants and spectators as well as me. I am electing to participate in this event in spite of risks.

2)       It is my express intent that this agreement shall bind the members of my family, my spouse, my children, my parents, my heirs, assigns, executor and / or personal representative and shall be deemed as FULL RELEASE, WAIVER, DISCHARGE AND COVENANT NOT TO SUE CRLLC

3)       I hereby voluntarily release, forever discharge, and agree to indemnify and hold harmless CRLLC from any and all claims, demands, or causes of action which are in any way connected with my participation in The Crusher Race or my use of CRLLC’s equipment, obstacles, event site or facilities including claims which allege negligent acts or omissions of CRLLC.

4)       I hereby agree that this agreement shall be construed in accordance with the laws of the State of Missouri, without reference to that State’s choice-of-law principles. I further agree that any action or litigation to or arising from this agreement or its subject matter be brought only in the Circuit Court for Saint Louis, County, Missouri or in the United States District for the Eastern District of Missouri.

5)       Should CRLLC or anyone acting on their behalf, be required to incur attorney’s fees and costs to enforce this agreement, I agree to indemnify and hold them harmless for all such fees and costs.

6)       I certify that I have adequate insurance to cover any injury or damage I may cause or suffer while participating, or else I agree to bear the costs of such injury or damage myself. I further certify that I am willing to assume the risk of any medical or physical condition I may have.

7)       By signing this document, I acknowledge that if anyone is hurt or property is damaged during my participation in The Crusher Race, I may be found by a court of law to have waived my right to maintain a lawsuit against CRLLC on the basis of any claim from which I have release herein. I have had sufficient opportunity to read this entire document. I have read and understood it, and agree to be bound by its terms.

8)   I further grant CRLLC the right to photograph, videotape, digitally record, and or otherwise record my name, face, likeness, voice and appearance in connection with exhibitions, publicity, social media, advertising, and promotional; material without reservation or limitation.
