IMPORTANT: THIS IS A WAIVER AND RELEASE OF POTENTIAL LEGAL CLAIMS FOR PERSONAL INJURY AND PROPERTY DAMAGE. PLEASE READ THIS DOCUMENT CAREFULLY. I consent to participation in the Arizona Super Bowl Host Committee’s 4.9K Fun Run on Saturday December 13th, 2014 (the “Event”). I understand the Event involves physical activities such as running, jogging, walking and other similar forms of physical activity and that participation in the Event requires training and physical conditioning. I understand that, by signing this agreement, I agree that I/(my child) am/is physically able to perform the above listed activities in a way that does not pose a threat of damage, illness, injury or death to myself/my child or others involved in the Event. I understand there is risk of damage, illness, injury or death with this type of event which may be caused by different factors, including but not limited to the negligence, in whole or part, of the Released Parties, as defined below. In consideration of the above, I fully assume all risks of damage, illness, injury or death I/(my child) may suffer as a result of participation in the Event. Knowing the risks described above, I agree, personally and on behalf of my minor child, to assume all the risks and responsibilities surrounding participation in the Event, including but not limited to any damage, illness, injury or death resulting from the negligence, in whole or part, of the Released Parties, as defined below. I hereby expressly and unequivocally release and discharge the National Football League, its thirty-two (32) member professional football teams, NFL Properties LLC, NFL Ventures L.P., the Arizona Super Bowl Host Committee, Wild Horse Pass Development Authority (“WHPDA”), Rawhide Western Town and Steakhouse, the Gila River Indian Community it’s departments, agencies, assigns and agents, Sage-Sports LLC and the Arizona Community Foundation and all of their respective officers, directors, employees and volunteers, subcontractors, sponsors, agents, affiliates, subsidiaries and shareholders (collectively the “Released Parties”) from any and all claims, actions, causes of action, demands, rights, damages, costs, expenses and compensation whatsoever that may be made by me, my family, estate, heirs or assigns for property damage, personal injury, or wrongful death arising as a result of my and/or my child’s participation in the Event wherever, whenever or however the same may occur, including but not limited to any damage, illness, injury or death resulting from the negligence, in whole or part, of the Released Parties. I will additionally permit the free use of my/ (my child's) name and/or picture in a broadcast, telecast, newspaper, on a website or account of this Event. IF PARTICIPANT IS UNDER 18: This is to certify that my child has my permission to compete in this Event, is in good physical condition and that race officials have permission to authorize emergency treatment if necessary. I warrant that all statements made herein are true and correct and understand that Released Parties have relied on them in allowing me/(my child) to participate:. I am not under any legal disabilities that prevent me from being legally bound by this Waiver and Release of Liability for Personal Injury and Property Damage (this “Release”). I agree that this Release, and any dispute arising from or involving this Release, shall be governed by and construed in accordance with the laws of the State of Arizona.
