THE GRANDE PRAIRIE ZULU CHALLENGE
WAIVER OF LIABILITY AND
RELEASE OF ALL CLAIMS
In consideration of being allowed to participate in the Grande Prairie Zulu Challenge (the āEventā) and/ or activities, I, the undersigned, acknowledge, covenant and agree that:
1. The personal injury, death or property loss resulting from any cause whatsoever from being involved in the Event is significant, including but not limited to drowning, near drowning, strains, sprains, fractures, heat or cold injuries, animal bites and/or stings, altitude, weather, heart attack, potential for permanent paralysis, accidents involving, but not limited to climbing, vehicles, hiking and any other risk that may be associated with extreme racing events.
2. I fully acknowledge that he or she is physically fit and sufficiently trained to participate in this extreme event, in which altitude, weather and obstacles will be a significant factor and present risk as outlined in point 1 above.
3. I, knowing these facts stated above, nevertheless, in consideration for participating , hereby for myself and on behalf on my heirs, assigns, personal representatives and/or next of kin, forever WAIVE, RELEASE and DISCHARGE the Grande Prairie Zulu Challenge, 1777271 Alberta Ltd., Municipal District of Greenview No. 16, City of Grande Prairie, Nitehawk Ski Hill, any official sponsor entity, and the directors, shareholders and/or members, agents, and employees of each, all medical and other personnel assisting with the race, volunteers, or any other person connected with the event, from any and all rights, claims of or in connection with the my participation in the event.
4. I further agree to indemnify, defend and hold harmless Releases from any loss, liability, cost, claim or damages arising from my participation in or association with activities and events organizes and sponsored by the Grande Prairie Zulu Challenge and/or 1777271 Alberta Ltd. or connected with the Event.
5. After opportunity to fully inform myself about the Event, I knowingly assume and accept all such risks, both known and unknown, and assume full responsibility and all risks for my participation in the Event.
6. I voluntarily agree to comply with the stated and customary terms and conditions for participation. If, however, I observe any significant and/or unusual hazard during my presence or participation, I will remove myself from participating and bring such hazard to the attention of the nearest official.
7. I consent to the administration of first aid and other medical treatment in the event of injury or illness and hereby release and indemnify Releases from any and all liability or claims arising out of such treatment.
8. I attest and verify that, unless otherwise indicated below, I am over 18 years of age, am free from all illness, injuries and defects that could interfere with my safe participation in the Event and that I am physically fit and sufficiently trained to participate in all activities associated with the Event. My participation in the activities and events organized or sponsored by the Grander Prairie Zulu Challenge and 1777271 Alberta Ltd. is entirely voluntary. I further certify and represent that on the date of the Event, I will possess and be covered by medical/health insurance, individually or as part of an organization.
9. The Releasees reserve the right, in the sole and absolute discretion, to postpone, cancel, or modify the Event due to weather conditions, Acts of God or other factors beyond the control of the Releasees that might affect the health and/or safety of the participants. No REFUNDS will be granted.
10. I grant my irrevocable permission to the Grande Prairie Zulu Challenge and its authorized agents to use, sell reproduce and distribute any and all photographs, images, videotapes, motion pictures, recordings, or any other depiction of any kind of me or my participation in the Event or related activity for any legitimate purpose in the perpetuity and I understand that I shall not be entitled to any compensation therefore.
11. In consideration and in return for being allowed to participate in the Event, I release and agree not to sue the Releasees from all present and future claims regarding my participation in the Event that may be made by me, my family, estate heirs or assigns. If any legal proceedings arise, I also hereby agree for such to be subject to the laws of Alberta Canada and dealt within the jurisdiction of Alberta and no other jurisdiction.
12. The Grande Prairie Zulu Challenge reserves the right to refuse any entry. No entry will be accepted without full payment and no refunds will be issued once entry is accepted. Absolutely no entry will be accepted without a signed Waiver of Liability and Release of all Claims Agreement.
I HAVE READ THIS WAIVER OF LIABILITY AND RELEASE OF ALL CLAIMS AGREEMENT FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND SIGN IT FREELY AND VOLUNTARILY WITHOUT AND INDUCEMENT.

The undersigned, _________________________________________________________, hereby certifies, warrants and represents that I am the legal parent or guardian of ____________________________________________________,The signer of the above Release (the āParticipantā), and that after fully informing myself regarding the nature and risks of the Event, I give my permission for the Participant to participate in the same and by my signature below I fully ratify, accept and agree to all of the terms of the Release both for myself and as legal parent or guardian of the Participants.
