PARTICIPANT BOOKING TERMS & CONDITIONS, WAIVER, IMAGE RELEASE & RELEASE OF LIABILITY&nbsp; &nbsp; Please read all sections carefully before agreeing to the Terms & Conditions below. Please note that if you are signing up on behalf of other participants, you agree to these conditions on their behalf too. If you wish to pass responsibility of agreement of conditions on to the individual participant, please ensure they enter themselves online.&nbsp; &nbsp; Your entry to and participation of your selected event (“the Event”) is provided to you by Muscle Acre Events hereinafter referred to as (“us”, “our” or “we”) and is subject to these terms and conditions. References to the Event include all aspects of the Event organised by us including, access, parking, the venue and the activity. By entering and participating in the Event you understand and accept the following terms and conditions:&nbsp; &nbsp; Nature of the Event, Risks and your Responsibilities&nbsp; &nbsp; You knowingly and freely assume accept all such risks, both known and unknown, and take full responsibility for your participation in all elements of the Event. You recognise the inherent risks associated with the Event and consider yourself physically and mentally able to take part in it.&nbsp; We will use reasonable care and skill to provide an Event that is fit and suitable for participants bearing in mind the paragraph above. Note that it is not possible to remove all elements of risk without compromising the unique challenging nature of the event. The Event will be held in a challenging outdoor environment that may include: mud, water, adverse weather conditions, hills, contact with poisonous plants and ticks. Some of the activities within the Event may include: running across undulating, rough and difficult terrain; tackling obstacles such as barbed wire, bales, hurdles, water features, trenches or logs pipes, traversing under and over cargo nets, climbing over walls, climbing up/over/and through rope, cord and bungee obstacles, wading in cold water, and traversing muddy and boggy areas. You acknowledge, accept and understand that the terrain and obstacles involved in the Event may be physically and mentally challenging are hazardous and, due to the nature of the Event, there is an inherent risk of acute illness, injury or even death. The Event features immersion in water and the use of mud and other natural and non-natural substances at some of the Obstacles. You accept that the Organisers are not liable for the quality of static bodies of water as this can never be guaranteed. Likewise, you accept that the Organisers are not liable for any mud and/or other substances used in this Event harbouring some levels of naturally occurring bacteria which could lead to illness if ingested. Further, you understand that open wounds must be covered prior to taking part in the event.&nbsp; &nbsp; You are responsible for your own safety throughout the entire Event and you are taking part in the Event entirely at your own risk. You will adhere to any instructions given to you by the organisers, officials and marshals before, during and after the event. You agree to behave appropriately at all times, act respectfully towards all people, equipment, property and facilities and participate in the Event with a cooperative and positive attitude. You will notify the organisers, officials and marshals as soon as possible if you believe or become aware that any aspects of the Event course, facilities or equipment are unsafe or pose unreasonable risks to yourself or others. You will pay us and any persons or organisations acting on our behalf for any damages, loss or costs caused by any of your negligent or destructive behaviour during the event. You accept full and sole responsibility for the condition and adequacy of all personal equipment that you bring to or use at the Event and we accept no responsibility for loss or damage to your property.&nbsp; &nbsp; We reserve the right to cancel or close down the event if we consider there is an unacceptable risk to the event participants, our staff or the general public. In this highly unlikely happening (e.g. extreme weather) we will do our utmost to reorganise the Event for another date but cannot guarantee a replacement and we will not be able to refund the entry fee or any other costs associated with the Event. We therefore recommend getting event cancellation insurance. You should ensure that you are covered by private medical insurance to take part in this event. If you have an existing policy you should ensure that you are adequately covered to take part in the Muscle Acre Runs.&nbsp; &nbsp; Rules of the Race&nbsp; &nbsp; You will not give your race entry to anyone else, pretend to be anyone else or swap any participant timing chip during the Event. You will be running and negotiating obstacles with many other people and will show due consideration to their safety and enjoyment along with your own. If you see anyone who requires additional help or medical assistance you will help to the best of your ability and report the situation to an Event marshal as soon as possible. You must not deviate from the official route, which will be clearly marked. There will be horses in surrounding fields and it is important that you stick to the course as marked. Entrance into the surrounding fields that are not part of the marked route is strictly prohibited. You understand that this event takes place in part, on public footpaths. i.e., cycles and pedestrian traffic could be using the paths. Therefore you must give way to any pedestrian or cyclist requiring to use the path and obey all relevant local byelaws.Should you retire from the race at any point you will inform the nearest marshal or staff member as soon as possible and follow their directions as to the safest return route to the start/finish area where you must inform race HQ of your retirement. &nbsp; All race entries are non-refundable. It is possible to transfer your entry to another person up to two weeks prior to event date, but after this time, no transfers can be made. It is not possible to transfer your entry to another race. If you have pre-purchased multiple tickets, these are also non-refundable, even in cases where the places have not been claimed.&nbsp; &nbsp; Should the race be cancelled on the event day for reasons out of the control of Muscle Acre Events (for example, due to an act of God, terrorism, environmental, transportation or other external factors), no refund or compensation will be offered.&nbsp; &nbsp; Medical Disclaimer&nbsp; &nbsp; You understand and acknowledge that participation in the Event may cause injury or injuries that may be categorised as minor, serious or catastrophic (see below). Minor injuries are common and may include but are not limited to scrapes, bruises, sprains, strains, nausea and cuts. Serious injuries are less common but do sometimes occur. They include but are not limited to property loss or damage, broken bones, torn ligaments, concussion, exposure, heat-related illness, mental stress or exhaustion and infection. Catastrophic injuries are rare; however, we feel that our participants should be aware of the possibility. These injuries can include permanent disabilities, spinal injuries and paralysis, stroke, heart attack and even death. In the event of an accident or illness whilst taking part in this event, you hereby give permission to our staff and contracted first aiders to initiate first aid treatment, any necessary medical transportation and to inform your next of kin. We take no responsibility for the actions of contracted services involved in the Event. You agree to take part in this Event at your own risk and you will not hold us or our contractors responsible in the event of acute illness, injury or death. You will inform us and associated first aid contractors of any medical conditions when being given treatment.&nbsp; &nbsp; You do not have to be an athlete to participate in these activities but you should be reasonably fit and be aged 13 and over on the day of the event. Those who are pregnant or under the influence of alcohol or drugs should not take part. Those with asthma, epilepsy, diabetes, a heart condition or any other medical condition which may be restrictive to their participation in this event should consult their doctor prior to signing up for the challenge. You are strongly advised not to participate if you are or have recently been suffering from a cold or flu symptoms.&nbsp; &nbsp; Throughout the Event, you acknowledge and accept that you may be checked for suitability to continue on grounds of capability based on your state of health. If any of the marshals and medical staff believe that your safety is compromised by continuing the race, they reserve the right to ask you to stop. If you continue in the Event you will no longer be officially participating in the Event and we take no further responsibility for your participation.&nbsp; &nbsp; Personal Data Terms and Conditions&nbsp; &nbsp; You may request access to, change or delete personal data held by us at any time. We may occasionally email you information regarding future events. You may opt out of this at any time.We may use your photographs or film taken during the event for the publicity of our events (e.g. online, print or broadcast media).The phone numbers of your next of kin and your medical information will not be used or shared with any third party, except with medical services during the event you are taking part in.&nbsp; &nbsp; Informed Consent and Liability Waiver&nbsp; &nbsp; Exercise and fitness activities, including the use of equipment and facilities, in the outdoors, are potentially hazardous activities which may involve a risk of personal injury.&nbsp; &nbsp; I hereby declare that I will be 17 years or over on the day of the Event I have voluntarily signed up for with full knowledge of the inherent dangers involved. I declare myself to be physically fit and healthy and not suffering from a condition, impairment, disease, infirmity or other illness that would prevent my participation in the activities and programmes or use of the equipment or facilities of Muscle Acre Events.&nbsp; &nbsp; I hereby release Muscle Acre Events and hold Muscle Acre Events harmless from and against any and all liability for any loss, damage, personal injury or death resulting from my participation in any such activities or my use of any equipment or facilities in the above mentioned activities. I hereby waive, release and forever discharge Muscle Acre Events from any and all responsibility or liability for injuries or damage resulting from my participation in this event. I further certify that on the date of the Event I will possess and be covered by medical/ health insurance, individually or as part of an organisation.
