The Run With Heart Event is only being made available under the terms and conditions of this waiver and hold harmless agreement and the other agreements and documents signed in connection with participation in this event.  By signing this waiver and hold harmless agreement, you specifically understand and acknowledge that you will be participating in the Run With Heart Event and that there is an inherent risk of injury to you because of this.  Accordingly, by signing below, you understand and agree as follows:   
1.       You understand and acknowledge that some of the possible injuries or medical disorders that you may suffer include, but are not limited to, heart attack, stroke, heat stress, sprains, broken bones, torn muscles, and torn ligaments;
2.       You agree to assume all risk of personal injury, illness and/or death arising out of or resulting from your participation in the Run With Heart Event;
3.       You understand and acknowledge that RunFAR Racing Services, Inc., Methodist Mansfield Medical Center nor Methodist Health System (nor any employee, representative, or agent of them) undertake to monitor or supervise your participation in the Run With Heart Event;
4.       YOU EXPRESSLY AGREE TO FULLY WAIVE, RELEASE AND DISCHARGE METHODIST MANSFIELD MEDICAL CENTER AND METHODIST HEALTH SYSTEM AND ANY OF THEIR RESPECTIVE AFFILIATES, DIRECTORS, OFFICERS, AGENTS, REPRESENTATIVES, AND EMPLOYEES, AS WELL AS RUNFAR RACING SERVICES, INC., THE CITY OF MANSFIELD, OFFICIALS, ANY AND ALL SPONSORS OF THE RUN WITH HEART EVENT (COLLECTIVELY “RELEASEES”), FROM ANY AND ALL CLAIMS, LIABILITIES, DAMAGES, LOSSES, OR OTHER EXPENSES OF ANY NATURE WHATSOEVER (COLLECTIVELY “CLAIMS”) FOR ANY PERSONAL INJURY, ILLNESS, OR DEATH ARISING OUT OF OR RESULTING FROM YOUR PARTICIPATION IN THE RUN WITH HEART EVENT EXPRESSLY INCLUDING BUT NOT LIMITED TO ANY CLAIMS ARISING FROM ANY RELEASEE’S OWN NEGLIGENCE; 5.       You agree to indemnify and hold the Releasees harmless from any Claims released under Paragraph 4 above or incurred by the Releasees in defending against any Claims released under Paragraph 4 above. This indemnity obligation shall also include reasonable attorneys' fees, investigation costs, and other costs and expenses incurred by Releasees with respect to any Claims made against Releasees and whether or not such Claims arise out of any Releasee’s own negligence;
6.       You agree that this WAIVER AND HOLD HARMLESS AGREEMENT will be binding on you and your executors, administrators, personal representatives, heirs and minor children;
7.       You have been informed and fully understand that any information given to you by any experts, health professionals, personal trainers, nutritionists or physicians, or anyone else on behalf of the Run With Heart Event, is intended to be used for informational purposes only in your sole discretion. Such information is not medical advice, and you understand that you are encouraged to consult your own health care provider before using any such information, especially if you take any medications and/or are being treated for any illness or condition.  Should you decide to use all or any part of such information, this decision shall be entirely at your own risk; and
8.       You acknowledge that you have carefully read this WAVIER AND HOLD HARMLESS AGREEMENT, that you acknowledge your understanding of the risks described, and that you voluntarily and knowingly agree to accept full responsibility for your own exposure to such risks and any and all damages and injuries arising from such risks.
9.       I also grant full permission to any and all outlined herein to take and use any photographs, video tapes, motion pictures or other record of this event for any purpose.
10.   I FULLY UNDERSTAND THAT THERE ARE NO REFUNDS, TRANSFERS OR DEFERMENTS UNDER ANY CIRCUMSTANCES.
