Waiver

In consideration of being permitted to The Pursuit for Living Well (hereinafter "The Activity"), I hereby release, waive, discharge Living Well Disability Services, its officers, employees, and agents from liability for any and all claims including the negligence of Living Well Disability Services, its officers, employees and agents, resulting in personal injury, accidents or injuries (including death), and property loss arising from, but not limited to, The Activity.

 

Assumption of Risks

I understand that The Activity carries with it certain inherent risks that cannot be eliminated regardless of the care taken to avoid injuries. The specific risks may vary, but can range from 1) minor injuries such as scratches, bruises, and sprains 2) major injuries such as broken bones, joint or back injuries, and concussions, to 3) catastrophic injuries including paralysis or death.

 

I have read the previous paragraphs and I know, understand, and appreciate these and

other risks that are inherent in The Activity.  I hereby confirm that my participation is voluntary and that I knowingly assume all such risks associated with The Activity.

 

Indemnification and Hold Harmless

I also agree to indemnify and hold Living Well Disability Services, Mastel Event Management, LLC, USA Track & Field, and any organization associated with the race, and the local governments and police, volunteers, and any and all sponsors including their agents, employees, assigns or anyone acting on their behalf, harmless from any and all claims, actions, suits, procedures, costs, expenses, damages and liabilities, including attorney’s fees brought (whether by myself or by any third party) as a result of my involvement in The Activity and to reimburse them for any such expenses incurred.

 

Acknowledgment of Understanding

I have read this waiver of liability, assumption of risk, and indemnity agreement, fully understand its terms, and understand that I am giving up substantial rights, including my right to sue. I acknowledge that I am signing the agreement freely and voluntarily, and intend by my signature to be a complete and unconditional release of all liability to the greatest extent allowed by law.

 

I give my permission for medical team evaluation, treatment, and transfer to an emergency facility if needed. I agree that Living Well Disability Services officials have the right to remove me from the race and related activities if they are of the opinion that it is in my best interest or the best interest of Living Well Disability Services that I be removed.

 

I further grant permission to Living Well Disability Services and/or agents authorized by them to use any photographs, videotapes, motion pictures, recordings, or any other record of this event for any purpose without limitation or compensation.
