By registering for, and in consideration of the permission granted to me to participate in, the 2014 “Run with History” Half Marathon, Edwards Air Force Base, I hereby release and discharge the United States Government, the Department of Defense, the Department of the Air Force, the Edwards Non-Appropriated Fund (NAF) (including its officers, agents, and employees), Infinity Timing, Race Central, Chronotrack, any other company, organization, or individuals affiliated with the 2014 “Run with History” Half Marathon, and the officers, directors, agents, employees, or anyone acting on behalf of the 2014 “Run with History” Half Marathon Personnel, from any and all claims, demands, or actions or personal injury or property damage, or any other damage or loss which may be caused by any act or failure to act, including negligence by 2014 “Run with History” Half Marathon Personnel, which may arise out of my participation in the 2014 “Run with History” Half Marathon. Further, I specifically agree that I will indemnify, save, and hold harmless 2014 “Run with History” Half Marathon Personnel from any and all losses, claims, actions, or proceedings of any kind or character which may be presented or initiated by me, my heirs, or assigns, to recover money, property, or damages or for any injuries to persons or damages to property suffered at, or in association with, the 2014 “Run with History” Half Marathon.
By registering for, and participating in, the 2014 “Run with History” Half Marathon, I attest and verify that: 1) (i) I am at least eighteen (18) years of age or older (or that this document is also agreed to by my parent or legal guardian); and (ii) I am in good health and proper physical condition, such that I can participate in the 2014 “Run with History” Half Marathon; 2) I understand and acknowledge that participation in the 2014 “Run with History” Half Marathon is inherently dangerous and represents an extreme test of a person’s physical and mental limits. I understand and acknowledge the risks and dangers associated with participation in the 2014 “Run with History” Half Marathon, including without limitation, the potential for serious bodily injury, sickness and disease, permanent disability, paralysis and loss of life; loss of or damage to equipment/ property; exposure to extreme conditions and circumstances; contact with other participants, spectators, animals or other natural or manmade objects; dangers arising from adverse weather conditions; imperfect course or track conditions; land, water, and surface hazards; equipment failure; inadequate safety measures; participants of varying skill levels; situations beyond the immediate control of the 2014 “Run with History” Half Marathon Organizers; and other undefined, not readily foreseeable and presently unknown risks and dangers (“Risks”). I understand that these Risks may be caused in whole or in part by my actions or inactions, the actions or inactions of others participating in the 2014 “Run with History” Half Marathon, or the negligent acts or omissions of the United States Government, the Department of Defense, the Department of the Air Force, the Edwards NAF (including its officers, agents, and employees), Infinity Timing, Race Central, Chronotrack, any other company, organization, or individuals affiliated with the 2014 “Run with History” Half Marathon, and the officers, directors, agents, employees, or anyone acting on behalf of the 2014 “Run with History” Half Marathon Personnel, and I hereby expressly assume all such Risks and responsibility for any damages, liabilities, losses or expenses which I incur as a result of my participation in the 2014 “Run with History” Half Marathon;
3) I agree to be familiar with and abide by all rules and regulations established for the 2014 “Run with History” Half Marathon including but not limited to Competition Rules adopted by USA Track and Field, any anti-doping rules established by the appropriate entity, and any safety regulations established for the benefit of all participants. I accept sole responsibility for my own conduct and actions while participating in the 2014 “Run with History” Half Marathon, and the condition and adequacy of my equipment. 4) I specifically waive any and all claims arising out of such risks and dangerous conditions and understand I will have no right to make any claim or file any lawsuit against any of the 2014 “Run with History” Half Marathon Personnel listed above, to include the United States Government and its officers, directors, agents, and employees; 5) I hereby warrant that I (or my parent, natural guardian, or legal guardian, if I am under the age of 18) am of legal age and competent to enter into this Agreement, that I have read this Agreement carefully, understand its terms and conditions, acknowledge that I will be giving up substantial legal rights by accepting it (including the rights of my spouse, children, guardians, heirs and next of kin, and any legal and personal representatives, executors, administrators, successors and assigns), acknowledge that I have accepted this Agreement without any inducement, assurance or guarantee, and intend for my acceptance to serve as confirmation of my complete and unconditional acceptance of the terms, conditions and provisions of this agreement. This Agreement represents the complete understanding between the parties regarding these issues and no oral representations, statements or inducements have been made apart from this Agreement. If any provision of this Agreement is held to be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from this Agreement and shall not affect the validity and enforceability of any remaining provisions. 6). I certify that the birth date and age information provided in my member profile and confirmed at the beginning of the entry process is true and accurate. 7). If the participant is under the age of 18, the parent, natural guardian, or legal guardian (the “Guardian”) hereby agrees to release and discharge the United States Government, the Department of Defense, the Department of the Air Force, the Edwards NAF (including its officers, agents, and employees), Infinity Timing, Race Central, Chronotrack, any other company, organization, or individuals affiliated with the 2014 “Run with History” Half Marathon, and the officers, directors, agents, employees, or anyone acting on behalf of the 2014 “Run with History” Half Marathon Personnel as follows:
1. The Guardian acknowledges and understands that the 2014 “Run with History” Half Marathon is inherently dangerous and represents an extreme test of a person’s physical and mental limits. Further, the Guardian acknowledges and understands the Risks, as defined above. 2. The Guardian acknowledges the rights waived by both the Guardian and the participant by accepting this Agreement. 3. The Guardian acknowledges that the Guardian will indemnify the United States Government, the Department of Defense, the Department of the Air Force, the Edwards NAF (including its officers, agents, and employees), Infinity Timing, Race Central, Chronotrack, any other company, organization, or individuals affiliated with the 2014 “Run with History” Half Marathon, and the officers, directors, agents, employees, or anyone acting on behalf of the 2014 “Run with History” Half Marathon Personnel from any and all Liability which may arise out of, result from, or relate in any way to the participant’s participation in the 2014 “Run with History” Half Marathon, including claims for Liability caused in whole or in part by the negligent acts or omissions of the United States Government, the Department of Defense, the Department of the Air Force, the Edwards NAF (including its officers, agents, and employees), any other company, organization, or individuals affiliated with the 2014 “Run with History” Half Marathon, and the officers, directors, agents, employees, or anyone acting on behalf of the “Run with History” Half Marathon Personnel. 8) I have read and understand all rules and regulations that apply to participants of the 2014 “Run with History” Half Marathon.
GENERAL TALENT RELEASE The United States Government has requested that I grant, release, and discharge certain rights arising from my appearance, or the appearance of an infant or minor child for whom I execute custody, in any picture, video, advertisement, or other recording or presentation as a result of my participation in the 2014 “Run with History” Half Marathon. I hereby grant and release to the United States Government the right to use my name, likeness, and personal information, or that of said infant or minor child, in any manner, and to photograph, videotape, make motion pictures, recordings or any other record of the 2014 “Run with History” Half
Marathon;to reproduce, duplicate, publish, exhibit, use or transmit the same or any parts thereof, by any means, in any manner and for any purpose whatsoever; and to do the same perpetually. This voluntary grant and release will not be made the basis of a future claim of any kind against the United States Government. I release and discharge the United States Government from any cause of action arising from my participation or the participation of the infant or minor child in the production. This grant, release, and discharge shall inure to the benefit of the United States Government, and its officers, agents, servants, and employees when acting in their official capacities; and to persons, firms or corporations contracting with the United States Government, and their heirs, executors, administrators, successors, or assigns; and to any other persons lawfully reproducing, distributing, exhibiting, or otherwise using the said production or any portion thereof.
