RELEASE OF LIABILITY, COVENANT NOT TO SUE, WAIVER AND AGREEMENT
By signing this agreement, I acknowledge that I understand that participating in running or walking on public roadways could be
potentially hazardous and may result in serious injury or death. I understand that this activity in which I am voluntarily participating
has inherent risks (including death, loss of limb and permanent disability, and damage to or loss of property) that I assume. I certify
that I am competent and physically able to participate in the Run For The Fallen 5K, 10K or 1 Mile Firefighter Challenge in a safe
manner. I am solely responsible to determine the speed in which I choose to walk or run while participating in this event. I hereby
agree to expressly and voluntarily accept and assume all risks involved while participating Run For The Fallen and any of its
Associated Events (1 Mile Firefighter Challenge, 5K or 10K).
I hereby covenant, as a participant of Run For The Fallen, not to sue the Village of Kronenwetter, Kronenwetter Lions Club, Run For
The Fallen Committee, National Fallen Firefighters Foundation, ChronoTrack Live, Tortoise & Hare Race Management, LLC, their
owners, agents, members, employees, officers, sponsors, directors, managers and representatives for any and all loss or damage
including property damage or loss, personal injury, permanent disability and/or death, arising out of my participation in this activity
(including but not limited to running, walking, transportation to and from the activity). The Village of Kronenwetter, Kronenwetter
Lions Club, Run For The Fallen Committee, National Fallen Firefighters Foundation, ChronoTrack Live, Tortoise & Hare Race
Management, LLC make no warranty regarding conditions, safety of roadways or weather, and I assume all risk that the conditions,
safety of roadways, or weather are other than what is expected. I hereby release and hold harmless the Village of Kronenwetter,
Kronenwetter Lions Club, Run For The Fallen Committee, National Fallen Firefighters Foundation, ChronoTrack Live, Tortoise &
Hare Race Management, LLC, its owners, agents, members and sponsors, assigns and heirs against any and all claims, causes of
action, or any other liability of any kind arising from my participation in this event.
By signing this agreement, I agree to abide by all event requirements regarding safety and no use of alcohol or drugs and
agree that any violation of these requirements will result in the termination of my participation in the event. I certify that I have
no known physical or mental impairment that may affect my safety or the safety of the group. Further, I certify that I am not under
the influence of alcohol, any narcotic, or other drug that may impair my understanding or judgment.
By signing this agreement, I acknowledge that I have read this liability waiver and agreement and that I am waiving any claim as set
forth herein for myself, my spouse, personal representatives, assigns, heirs and next of kin. In consideration of being permitted to
participate in Run For The Fallen, I hereby release, waive, hold harmless, discharge, and agree to indemnify the Village of
Kronenwetter, Kronenwetter Lions Club, Run For The Fallen Committee, National Fallen Firefighters Foundation, ChronoTrack Live,
Tortoise & Hare Race Management, LLC, their owners, agents, members, employees, officers, sponsors, directors, managers and
representatives from any and all liability to me, my spouse, personal representatives, assigns, heirs and next of kin for any and all
claims, demands, liability, loss or damage (including property damage or loss, personal injury, permanent disability and/or death), in
any way resulting from or arising in connection with this activity.
I acknowledge that the entry fee paid is non-refundable and non-transferable. I acknowledge and agree that the Run For The Fallen
Committee, in its sole discretion, may delay or cancel the event if it believes the conditions on the race day are unsafe. In the event the
Run For The Fallen is delayed or cancelled for any reason, including but not limited to: fire, threatened or actual strike, labor
difficulty, work stoppage, insurrection, war, public disaster, flood, unavoidable casualty, acts of God or the elements (including
without limitation, rain, hail, hurricane, tornado, earthquake), or any other cause beyond the control of Run For The Fallen Committee
there shall be no refund of the entry fee or any other costs of participant in connection with the event.
I further agree to the irrevocable and unrestricted right to use and publish photographs of me, or in which I may be included, for
editorial trade, advertising, and any other purpose and in any manner and medium without compensation.
I HAVE READ THE FOREGOING AND INTENTIONALLY AND VOLUNTARILY SIGNS THIS RELEASE AND
WAIVER OF LIABILITY AGREEMENT. IF ATHLETE IS UNDER AGE 18 HIS/HER PARENT OR GUARDIAN MUST
SIGN THIS RELEASE AND WAIVER AGREEMENT. Athlete's Parent or Guardian's signature above certifies that my
son/daughter/ward has my permission to participate in the Event. Athlete's Parent/Guardian has read and understands the foregoing
RELEASE AND WAIVER OF LIABILITY AGREEMENT (above) and by signing intentionally and voluntarily agrees to its terms
and conditions. Athlete's Parent/Guardian further certifies that my son/daughter/ward is in good physical condition and is able to
safely participate in the Event. I hereby authorize medical treatment for him/her and grant access to my child's medical records if
necessary.
