PLEASE READ THIS DOCUMENT (THE "WAIVER AGREEMENT") CAREFULLY BEFORE SIGNING. THIS WAIVER AGREEMENT WILL AFFECT YOUR LEGAL RIGHTS AND WILL LIMIT OR ELIMINATE YOUR ABILITY TO BRING A FUTURE LAWSUIT.
I, intending to be legally bound and in consideration of acceptance of my entry into this race, do hereby for myself, my heirs, executors, assigns, and any one authorized or entitled to act on my behalf, forever waive and release Joint Base Anacostia-Bolling (JBAB) Morale, Welfare, and Recreation Fund, the Navy-Air Force Half Marathon & 5 Miler Fund, its officers, directors, agents, volunteers and employees, all states, cities, federal districts, counties, governmental bodies or departments, locations in which Navy-Air Force Half Marathon & 5 Miler Fund (the “Event”) or segments of the Event are held, and all Event sponsors, their representatives and successors (collectively “Releasees”), from all claims or liabilities of any kind arising out of my participation in the Event, even though that liability may arise out of negligence or carelessness on the part of the persons named in this waiver. Furthermore, I know that participating in a road race is a potentially hazardous activity and that I should not enter and participate in the Event unless I am medically able to participate and am properly trained. I understand that I do not need a physical examination to qualify to run the Event and that I participate at my own risk. I assume all risks associated with participating in the Event including, but not limited to, falls, contact with other participants, the effects of the weather, including high heat and/or humidity as well as cold temperatures, traffic, the conditions of the road, and the danger of injury or even death, all such risks being known and appreciated by me. I hereby consent to emergency treatment in the event of my injury or illness. Furthermore, I understand that if I do not participate in the Event or if the Event cannot be held because of an act of God or circumstances beyond the Navy-Air Force Half Marathon & 5-Miler Funds’ control, any expenses incurred or entry fees paid by me to participate in the Event will not be refunded. Furthermore, I understand that information provided by me will be compiled and utilized for purposes of administering, scoring, and promoting the Event. I hereby grant representatives of the Event and its sponsors full use of all information submitted in my application. Releasees or online registration provider, ChronoTrack, shall not be held liable for any loss of data. Finally, I release rights to all photographic material, motion pictures, recordings, and any other record of the Event to the forgoing to be used for legitimate purposes without any obligation or compensation to me.
