Participant Release & Waiver of Liability
Please read the following before signing this form. This is a waiver of certain
legal rights.

The undersigned, herein Participant, desires to participate in the IronLine 80
and/or IronLine 40 Dog Sled Races, the IronLine Recreational Race (12) or
IronLine FatBike Race, herein “The IronLine,” and the activities related to the
races. Participant understands that races take place in the wilderness areas of
Iron County in the State of Michigan, George Young's Recreation Complex,
and along snowmobile and other trails and that active forestry operations may
be in progress.
The Participant does hereby freely, voluntarily and without duress, executes this
release under the following terms:
1. Waiver and Release.
Participant does hereby release and forever discharge and hold harmless The
IronLine, Inc., The IronLine 80/40, IronLine Recreational Race, The IronLine
FatBike Race, the City of Iron River, Iron River Township, Bates Township,
Stambaugh Township, the Department of Natural Resources State of Michigan,
Iron County and trail property owners (including but not limited to GMO
Timberlands, KEWEENAW LAND ASSOCIATION, LIMITED, Lake Superior
Timberlands a.k.a. Molpus, Iron County Road Commission, Chicagoan Lake
home owners, George Young's Recreation Complex, the Iron County Chamber
of Commerce, the Apple Blossom Trail, and RV Park and other property
owners) as well as all sponsors, volunteers, contributors and their heirs,
successors and assigns (hereinafter called “The IronLine”) from any and all
liability, claims and demands of whatever kind or nature, either in law or in
equity, which arises or may hereafter arise from the Participant’s participation
in the IronLine 80/40/12 races & IronLine FatBike Race.
Participant understands that this Release discharges The IronLine including
those listed above from any liability or claim that the Participant may have against The IronLine with respect to any bodily injury, personal injury, illness,
death or property damage including injury or death to Participant’s dogs, that
may result from Participant’s involvement in The IronLine or its sponsors,
officers, directors, employees, agents or otherwise. Participant also
understands that The IronLine does not assume any responsibility for or
obligation to provide financial assistance or other assistance, including but not
limited to medical, health or disability insurance, in the event of injury or illness
including death resulting from Participant’s participation in The IronLine races.
Participant agrees to comply with and to be bound by the terms and conditions
of the Official The IronLine Race Rules and Policies, which are incorporated
herein by reference.
2. Medical Treatment
Participant understands that emergency medical services may not be available
on all parts of the racecourse. Participant does hereby release and forever
discharge The IronLine from any claim whatsoever which arises or may
hereafter arise on account of any first aid, treatment, or service rendered in
connection with Participant’s involvement in the The IronLine including any
veterinarian service to Participant’s animals.
3. Assumption of Risk
Participant understands that participation in The IronLine race may include
activities that may be hazardous to the Participant including his/her property
and dogs, and beyond the control of The IronLine. Participant hereby
expressly and specifically assumes the risk or injury or harm in these activities
and releases The IronLine from all liability for injury, illness, and death or
property damage resulting from the activities of the Participant’s participation
in the The IronLine.
4. Insurance
The IronLine does not carry or maintain, and expressly disclaims responsibility
for providing any health, medical, or disability insurance coverage for the
Participant. Each Participant is expected and encouraged to arrive with
medical and/or health insurance coverage in effect.
5. Photographic Release
Participant does hereby grant and convey unto The IronLine all rights, title and
interest in any and all photographic images and video or audio recordings for
distribution, transmission and exhibition via television and radio broadcast,
cablecast, satellite transmission, wireless, microwave, video-on-demand, video
streaming, downloading, podcasting (including video podcasting), print media
and internet protocol television and electronic broadcast in any and all media
including theatrical releases made by The IronLine during and following the
2015 IronLine races including, but not limited to any royalties, proceeds or
other benefits derived from such photographs or recordings. Participant
hereby authorizes the use of Participant’s name, likeness, voices, and
biography and those of Participant’s animals in connection with The IronLine
for promotional, fund-raising and historic use.
6. Other
Participant expressly agrees that this release is intended to be a broad and
inclusive as permitted by the laws of the State of Michigan, and that this
Release shall be governed by and interpreted in accordance with the laws of
the State of Michigan. Participant agrees that in the event that any clause or
provision of the Release shall be held to be invalid by a court of competent
jurisdiction, the invalidity of such clause or provision shall not otherwise affect
the remaining provisions of the Release, which shall continue to be
enforceable.
Participant agrees to indemnify, defend, and hold The IronLine, Inc. of Iron
River, Michigan, sponsor/parent of The IronLine harmless from and against any
and all claims arising out of or related to acts or omissions of the Participant
and from any and all costs, attorney fees, expenses and liabilities incurred in
the defense of any such claim, or any action or proceeding brought thereon.
Participant also acknowledges that he/she has had an ample opportunity to
review this agreement and to consult with his/her attorney, that he/she is
executing this agreement without any coercion, duress, or compulsion
whatsoever and is competent to do so, that his/her agreement is binding upon
the undersigned’s marital community, estate, heirs, executors, administrators,
successors, trustees and assigns, and each of them, in its entirety.
IMPORTANT NOTE: BY SIGNING THIS AGREEMENT THE PARTICIPANT IS
RELEASING ALL CLAIMS HE OR SHE MIGHT HAVE IN THE FUTURE
RELATING TO THE IRONLINE, INC., SPONSOR/PARENT OF THE IRONLINE
80/40/12 OR IRONLINE FATBIKE RACE, AND ITS RACE COMMITTEE, EVEN
THOSE FOR DAMAGES AND INJURIES WHICH MAY BE CAUSED BY THE
SOLE NEGLIGENCE, CARELESSNESS OR FAULT OF STATED PARTIES AND
RELATED PERSONS.
