Photo/Recording Release. In consideration for me and/or my child’s participation in the Rooney’s Veterans 5K Run/Walk (“Rooney’s
5K”), I grant Rooney’s Golf Foundation, Inc., Rooney’s Beer Company, Elite Runner’s Race Management, the Town of Murrsyville, the County
of Westmoreland, 5K Brewing Company, and any sponsors of Rooney’s 5K (collectively, the “Released Parties”) the right to photographs
(“Photographs”), audio recordings or video recordings, and any reproduction thereof (“Recordings”), taken of me and/or my child in connection
with Rooney’s 5K, and the right to copyright, publish, reproduce, or otherwise use my and/or my child’s full name, biography, voice, image, and
likeness for promotional, documentary, educational, or any other lawful purposes, in any and all media, in any manner throughout the world, and
for an unlimited number of times in perpetuity.
I waive any right that I may have to inspect or approve any finished product created or used by the Released Parties that contains
Photographs and/or Recordings of me and/or my child.
Drug Prohibition. I acknowledge that the use or possession of drugs and other illegal substances are prohibited at Rooney’s 5K, and
use or possession of such substances will lead to the immediate expulsion from Rooney’s 5K and forfeiture of any monies paid.
Release. I understand that there are certain significant risks inherent in my and/or my child’s participation in Rooney’s 5K including,
without limitation, physical injury or death. I understand the nature of Rooney’s 5K and knowingly accept the substantial risks involved. I
hereby release the Released Parties, their respective officers, directors, trustees, employees, volunteers, agents, representatives, successors, and
assigns from any and all responsibility of any nature and for any loss or damage to property or personal injury to me and/or my child while
participating in Rooney’s 5K, regardless of how such damage, injury, or harm arises, and regardless of who is at fault.
Indemnification and Hold Harmless. I indemnify and hold harmless the Released Parties, their subsidiaries and affiliates, their
respective officers, directors, trustees, employees, volunteers, agents, representatives, successors, and assigns, from and against any and all
claims, liability, demands, actions, causes of action, costs (including counsel fees), expenses, and damages whatsoever, at law or in equity, arising
out of the rights granted to the Released Parties in this Release. I acknowledge that the Released Parties will rely on this Release, potentially at
substantial cost to the Released Parties, and hereby agree not to assert any claim of any nature whatsoever against anyone relating to the exercise
of the permissions granted hereunder.
I expressly agree that this Release is intended to be as broad and inclusive as permitted by the laws of the Commonwealth of
Pennsylvania, and that any disputes arising out of this Release shall be resolved before a court of competent jurisdiction in the Commonwealth of
Pennsylvania. I acknowledge that I have read and understand this Release prior to signing it. I further certify that I am eighteen (18) years of age
