AGREEMENT AND LIABILITY WAIVER

By accepting this, you agree and understand to all of the following: I am participating in a Ham Fam Fitness After Dark Dash 5K Run/Walk event and understand by doing so this is a potentially hazardous activity and could result in injury or death. I know I will not participate and register for this event unless I am physically and medically able to do so and have had proper training. With my signature, I am stating and certifying that I am physically and medically able to participate and run in this event and I am in good health with proper training. I also will agree to follow any decisions of the Ham Fam Fitness After Dark Dash team members which is related to any part of my involvement of this event which will include permission for the Ham Fam Fitness After Dark Dash team member to take away or prohibit my inclusion for any reason they see fit. I declare that I have read all of the rules of the running event and I hereby agree to them. I will take any and all responsibility for any and all damages to or theft of my own property or to any injury to my body that might occur to me as a part of or resulting from or arising from me participating in the Ham Fam Fitness After Dark Dash 5K event. I do understand that skateboards, bicycles, scooters, rollerblades or roller skates, and animals are not allowed. I understand that if I am registering a child under the age of 18 or an incapacitated adult, I am representing and warrant that I am the parent or legal guardian of that party and have the legal authority to enter into this agreement and waiver on their behalf and by proceeding with this registration for the event, I agree that the terms of this agreement and waiver shall apply equally to all of the registered parties. I do agree to release and will never hold Ham Fam Fitness After Dark Dash, and/or all sponsors, vendors and their respective trustees, directors, employees and agents, harmless of myself, my heirs, executors and administrators, from all claims, damages, rights of action, present or future, whether the same be known, anticipated or unanticipated, arising or resulting from, or incident to, my participation in the Ham Fam Fitness After Dark Dash 5k event.
I hereby give all permission to all of the foregoing to use my photographs, movies, motion pictures, recordings or any other record of this event for any legitimate purpose.
Applicable Law; Consent to Jurisdiction. I agree that the statutes and laws of the State of California, United States of America, without regard to the conflict of laws principles thereof, will apply to all matters relating to this agreement and waiver. By accepting this and indicating thereto of this agreement and waiver, I am attesting to and affirm I have read and understand this agreement and waiver and I fully understand the terms. I also understand that I am giving up my rights to sue. I hereby acknowledge that I am signing this agreement and waiver by my own freedom and voluntarily with my intention I accept there to be a complete and unconditional release of all liability to the greatest extent that which is allowed by law.
