In consideration of the acceptance of this entry, I, on behalf of myself, my executors, heirs, agents, administrators, successors and assigns, hereby waive, release, and forever discharge all organizers, race directors, sponsors, contributors, officials, vendors, volunteers, and all other persons or entities involved with the Grand Forks 10 Mile, 10K, & 5K (the “Event”), including the cities or municipalities of Grand Forks, ND and East Grand Forks, MN, the Grand Forks and East Grand Forks Park Districts, Grand Forks County, Downtown Development Association, the University of North Dakota, and any and all other governmental entities with jurisdiction over the locations in which the Event or portions of the Event takes place, from any and all claims, causes of action, damages, losses and liabilities of any kind which may arise out of, result from, or otherwise relate to my participation in the Event, including but not limited to any claims for death, personal injury, property damage or theft, including claims based on negligence. I acknowledge that there are inherent dangers involved in participating in the Event, including but not limited to dangers due to running and walking, or caused by other participants, spectators and volunteers, road surfaces, traffic, weather and animals, and I understand that I will be participating at my own risk. I further acknowledge that the Event is an extreme test of fitness and endurance, and I attest and certify that I am or will be sufficiently fit and physically trained to safely participate in the Event. I agree that the Race Officials may, based on their judgment and in their absolute discretion, exclude, disqualify or withdraw me from the race for violation of the rules of the Event, or for medical or safety reasons. I hereby grant the Event, and all persons and entities involved the right, permission and authority to use my name, picture or video recording of me, in any publication or promotional materials, without compensation. I also understand that if the event is forced to convert to a virtual event by local authorities due to reasons related to pandemic or otherwise for the safety of participants and the community, I will respect the options provided by race officials with regards to refund, deferral or transfer to virtual. I understand all efforts will be made to avoid a switch to virtual, but at certain points in time, it may no longer be feasible for the Grand Forks Marathon Inc 501(c)3 entity to provide refunds or deferrals without drastic negative economic consequences to the entity & charities it supports.
