Liability Waiver

I hereby enter the Fools Five Race. I enter at my own risk and personally assume any risk or responsibility for injuries I incur as a direct or indirect result of my participation in this event. I further agree not to hold liable the Lewiston Area Chamber of Commerce, City of Lewiston, Winona County, Lewiston-Altura High School, or any party associated with this event.

Refund Policy

I understand that I will not receive a refund for this event if the event is cancelled for any reason.

Assumption of the Risk & Waiver of Liability Relating to Coronavirus/COVID-19

I understand and am aware that there are potential risks incidental to attending events by Fools Five, Inc. during the COVID-19 pandemic, some of which may be dangerous, and which may expose me to the risk of disease or illness.  I understand that due to the highly contagious nature of the COVID-19 virus and potentially any other virus that can be contracted from both symptomatic and asymptomatic people, there is a potential risk for the contraction of illness because of my participation in the program.  I further understand that, while health and safety precautions will be taken, Fools Five Inc. will not ultimately be responsible for determining whether any participant has or does not have COVID-19 or any other illness. 

By agreeing, I, on behalf of myself, voluntarily assume the risk that I may be exposed to and/or contract COVID-19 because of participating in events and agree and acknowledge that the Fools Five Inc. assumes no responsibility for the contraction of any illness because of my participation in the program.  I hereby voluntarily forever release, waive, discharge, and covenant not to sue Fools Five Inc. officers, directors, committee members, and volunteers (“Released Parties”), jointly and severally, from any and all liability, including any and all claims, demands, injuries, damages, causes of action (known or unknown), suits, or judgments of any and every kind (including attorneys’ fees), arising from any illness or disease that I (or any person who may contract an illness or disease such as COVID-19, directly or indirectly, from myself) may suffer as a result of my participation in events by Fools Five Inc. regardless of whether a COVID-19 infection and/or outbreak occurs before, during, or after I participate in any event by Fools Five Inc. and regardless of whether the illness or disease is directly or indirectly caused by the Released Parties actions, unless the illness or disease is caused by the Released Parties’ gross negligence or intentional acts.
