WAIVER, RELEASE, HOLD HARMLESS AND AGREEMENT NOT TO SUE

I, ______________________ (FULL NAME), fully understand that my participation in the City SEM 5k Turkey Dash/1k Trot  (hereinafter "event ") exposes me to the risk of personal injury, death or property damage. I hereby acknowledge that I am voluntarily participating in this event and agree to assume any such risks.

I hereby release, discharge and agree not to sue *_______City of South El Monte_______  for any injury, death or damage to or loss of personal property arising out of, or in connection with, my participation in the event/class from whatever cause, including the active or passive negligence of City of South El Monte and/or any other participants in the event.  The parties to this agreement understand that this document is not intended to release the City of South El Monte for liability arising from the sole or gross negligence of the South El Monte. 

In consideration for being permitted to participate in the event, I hereby agree, for myself, my heirs, administrators, executors and assigns, that I shall indemnify and hold harmless *____ City of South El Monte__ from any and all claims, demands actions or suits arising out of or in connection with my participation in the event/class.

Photography/Video Waiver

Photographs and video may be taken at any time at facilities owned and operated by the City of South El Monte. Your attendance and participation at City of South El Monte facilities will constitute your irrevocable consent to be photographed, videotaped and recorded, your irrevocable consent to the use of your likeness by City of South El Monte and others acting on its behalf, for the purpose of advertising and promotion in any media, throughout the world in perpetuity, including but not limited to television and the world wide web, and your waiver of any compensation or permission for such use.

I HAVE CAREFULLY READ THIS RELEASE, HOLD HARMLESS AND AGREEMENT NOT TO SUE AND FULLY UNDERSTAND ITS CONTENTS. I AM AWARE THAT IT IS A FULL RELEASE OF ALL LIABILITY AND SIGN IT ON MY OWN FREE WILL.
