I, AND, IF APPLICABLE, MY GUARDIAN, HAVE READ THIS RELEASE AND, AND I (AND, IF APPLICABLE, MY GUARDIAN) FULLY UNDERSTAND ITS OR THEIR TERMS, UNDERSTAND THAT I (AND, IF APPLICABLE, MY GUARDIAN) HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING THIS RELEASE AND HAVE SIGNED SUCH DOCUMENT(S) FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT, ASSURANCE OR GUARANTEE BEING MADE TO ME OR GUARDIAN AND I (AND, IF APPLICABLE, MY GUARDIAN), INTEND MY OR OUR SIGNATURE(S) TO BE EACH A COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILITY TO THE FULLEST EXTENT ALLOWED BY LAW. ALL SECTIONS OF THIS RELEASE MUST BE COMPLETED. For and in consideration of Peoples Foundation of Northwest Florida Inc., allowing me, the undersigned, to participate in the Rock4Vets 5k run/walk event described above (the “Event” or “Events”), I, for myself, and on behalf of my spouse, children, guardians, heirs and next of kin, and any legal and personal representatives, executors, administrators, successors and assigns, hereby agree to and make the following contractual representations pursuant to this Waiver and Release of Liability, Assumption of Risk and Indemnity Agreement (the “Agreement”);
BY SIGNING THIS CONSENT, WAIVER, AND RELEASE FROM LIABILITY, I acknowledge the risks involved in participating in the Peoples Foundation of Northwest Florida Inc. and Gulf Coast Event Group Inc. events, including the Rock4Vets 5k run/walk and Rock4Vets Concert Event. I understand that these activities carry an above-average risk of personal injury to myself and my property. I willingly and knowingly accept the terms and conditions outlined in this Release.
I hereby represent that (i) I am at least eighteen (18) years of age or older; (ii) I am in good health and in proper physical condition to participate in the Event; and (iii) I am not under the influence of alcohol or any illicit or prescription drugs which would in any way impair my ability to participate in the Event safely. I agree that it is my sole responsibility to determine whether I am sufficiently fit and healthy enough to participate in the Event and that I am responsible for my safety and well-being at all times and under all circumstances while at the Event site.
Participating, volunteering, or spectating at the Events entails significant risks, including bodily injury, permanent disability, illness, death, emotional trauma, property damage, and other physical or emotional harm. I assume full responsibility for any such risks arising from my participation, whether caused by myself, other participants, or the entities involved in organizing the Events. I declare that I am in good health and have no physical conditions hindering my participation. I have not received any medical advice advising against my involvement after a recent examination. I confirm that I have medical insurance coverage, individually or through an organization or family.
Before participating, I or my guardian will inspect the Events' facilities, site, and equipment. If any aspect is deemed unsafe, I or my guardian will promptly notify Events officials, leave the premises immediately, and refrain from further participation until the unsafe condition is resolved. This agreement binds me, my personal representatives, heirs, and next of kin. I acknowledge that I have read and understood the terms of this Consent, Waiver, and Release From Liability and voluntarily agree to its provisions. By participating in the Events, I agree to be familiar with and abide by the Rules and Regulations established for the Event, including but not limited to any safety regulations established for the benefit of all participants. I accept sole responsibility for my own conduct and actions while participating in the Event and the condition and adequacy of my equipment. I agree to adhere to all guidelines set by the CDC, State authorities, County officials, City government, or any applicable movement restrictions laws. The Events are not responsible for determining my eligibility to participate; that is determined by local government authorities.
I hereby release, waive, and discharge Peoples Foundation of Northwest Florida Inc., Gulf Coast Event Group Inc., their affiliates, agents, contractors, volunteers, government entities responsible for event areas, sponsors, promoters, participants, charity partners, producers, sanctioning organizations, rescue personnel, advertisers, property owners, and all individuals involved in evaluating risks or providing instructions related to the Events (collectively referred to as "Releasees") from any liability for any loss, damage, injury, or claims arising from my participation or that of others. This includes injuries resulting from the condition of the event site, facilities, or equipment, as well as rescue operations or procedures, regardless of whether the Releasees are at fault.
I acknowledge that unknown conditions could affect my decision to participate in the Events or execute this release. I assume all risks associated with such unknown conditions. Furthermore, I agree to indemnify, defend, and hold the Releasees harmless from any losses, liabilities, damages, costs, or legal fees incurred as a result of my participation in the Events, whether caused by the negligence of the Releasees or otherwise. This release applies to all acts or omissions, negligent or otherwise, by the Releasees in connection with the Events, including rescue operations or procedures. It is intended to be as broad and inclusive as permitted by law, and if any part of this release is deemed invalid, the remaining provisions shall remain in full legal force and effect.
I agree and give consent for Peoples Foundation of Northwest Florida Inc. and their agents to record and capture my image, voice, and actions during the Events without compensation. I acknowledge that all resulting photography, videos, and recordings are the exclusive property of Peoples Foundation of Northwest Florida Inc. I also grant Gulf Coast Event Group Inc. and Peoples Foundation of Northwest Florida Inc. the unrestricted right to use my name, image, likeness, voice, testimonials, and biography for any purpose related to the Events, including distribution, advertising, promotion, and entertainment programming, across various media platforms. This consent extends globally and indefinitely without any further compensation to me. I release Peoples Foundation of Northwest Florida Inc., its employees, assigns, and licensees from any liability arising from the use of my information or likeness. Furthermore, I agree not to make any claims against the Releasees regarding the use or exploitation of my personal information, image, or likeness.
By voluntarily participating in the Rock4Vets 5k run/walk, I waive all claims and release Peoples Foundation of Northwest Florida Inc., its employees, representatives, agents, contractors, and subcontractors from any liability, including personal injuries or wrongful death, arising from my participation or travel to/from the events. This release applies even if negligence or other fault contributed to the incident, including dangerous property conditions or defective equipment. I acknowledge that I am releasing these parties from any liability without fault and agree to hold them harmless.
I FULLY UNDERSTAND I AM FOREVER GIVING UP, IN ADVANCE, ANY RIGHT TO SUE OR MAKE ANY CLAIM AGAINST THE PARTIES I AM RELEASING IF I SUFFER SUCH INJURIES AND DAMAGES, EVEN THOUGH I DO NOT KNOW WHAT OR HOW EXTENSIVE THOSE INJURIES AND DAMAGES MIGHT BE, AND AM VOLUNTARILY ASSUMING THE RISK OF SUCH INJURIES AND DAMAGES.
REFUNDS
Registration fees are non-refundable and will not be reimbursed for any reason, including injuries, unexpected emergencies, or medical issues. In the event of a course alteration, cancellation due to an act of nature, or a change in event time beyond our control, no refunds will be provided. However, if the event is canceled, your ticket will be honored at a future event.
