In consideration of you accepting this entry, I the participant, intending to be legally bound do hereby waive and forever release any and all right and claims for damages or injuries that I may have against the Jesse James Festival Incorporated ., and all of their agents assisting with the event, sponsors and their representatives, volunteers and employees for any and all injuries to me or my personal property. This release includes all injuries and/or damage suffered by me before, during, or after the event. I recognize, intend and understand that this release is binding on my heirs, executors, administrators, or assignees.

I know that running a trail race is potentially hazardous activity, which could cause injury or death. I will not enter and participate unless I am medically able and properly trained, and by my signature, I certify that I am medically able to perform this event, and am in good health, and I am properly trained. I agree to abide by any decision of a race official relative to any aspect of my participation in this event, including the right of any official to deny or suspend my participation for any reason whatsoever. I attest that I have read the rules of the race and agree to abide by them. I assume all risk associated with running in this event, including but not limited to: falls, physical contact with other participants, volunteers, race personnel contract service providers, employees, and spectators including the potential the contraction of communicable disease resulting from contact with other participants, volunteers, race personnel, contract service providers, employees, and spectators. I assume all risk including: the effects of the weather, high heat and/or humidity; freezing cold temperatures; running in low light conditions, traffic and the conditions of the road/trail including surrounding terrain.

In the event of illness, injury or medical emergency arising during the event I hereby authorize and give my consent to the Jesse James Festival Incorporated to secure from any accredited hospital, clinic and/or physician any treatment deemed necessary for my immediate care, I agree that I will be fully responsible for payment of any and all medical services and treatment rendered to me including but not limited to medical transport, medications, treatment, and hospitalization.

 I release, discharge and agree not to pursue legal action against the groups designated below, the  trail  owner or other entity designated below, including The City of Kearney and the Jesse James Festiva Incorporated or their owners, officers, agents, servants, volunteers, sponsors, associations, employees, or any person or entity connected with the team, league, field, City of Kearney and / or  Jesse James Festival Incorporated, for any claim, damages sustained or incurred by me from whatever cause including but not limited to the negligence, breach of contract or wrongful conduct of the parties hereby released. I understand that there are to be no refunds given in the event of race cancellation due to but not limited to the weather or unforeseen circumstances.

Photo Release: I grant permission to all the foregoing the right to use any photographs, motion pictures, recording, or any record of this event for any legitimate purpose. I authorize Jesse James Festival Committee Inc, its assigns and transferees to copyright, use and publish the same in print and/or electronically. I agree that Jesse James Festival Committee, Inc may use such Medias with or without the use of my name (s) for any lawful purpose, including for example such purpose as publicity, illustration, advertising, and web content.

By Submitting this entry, I acknowledge (or a parent or adult guardian for all children under 18 years) having read and agree to the above release and waiver.
