Release and Waiver of Liability 

In consideration of the opportunity to participate in the following event and/or activity: Women’s Health RUN 10 FEED 10 New York City 10k race (“Event”), I, on behalf of myself, my agents, heirs, executors, personal representatives, spouse, children, and next of kin, hereby agree to waive, release, indemnify, and hold harmless Rodale Inc., The FEED Foundation, FEED Projects, LLC, LeadDog Marketing Group, Inc.,  The City of New York, Hudson River Park’s Pier 84 and their respective employees, agents, directors, officers, representatives, successors, assigns, affiliates, subsidiaries, magazine titles, or other assets (collectively “Rodale”) from: (a) any and all responsibility and/or liability for personal injury, including death, and damage to or loss of property, whether or not arising from the negligence of Rodale or otherwise, that I may, in any way, may incur in connection with, related to, or while I am participating in, the Event and (b) any and all claims, liens, judgments, awards, fines, and costs (including reasonable attorney’s fees) of whatever nature that it is alleged and/or proven that Rodale is responsible for.  I accept and assume all risks associated with my voluntary participation in the Event, including, but not limited to: falls, slips, trips, contact with other participants, exercise related injuries, malfunctioning equipment or structures, improper instructions and/or advise, conditions of the property, weather, consumption of beverages or food, or any other risks of every kind known and/or appreciated, or that could and/or should have been known and/or appreciated, by me. I likewise understand and acknowledge that there may be other risks not known or reasonably foreseeable by me no enumerated herein, and I accept and assume those risks, as well.   In the case of injury or medical emergency, I agree that Rodale has the right, but not the obligation, to seek, administer, and/or have administered whatever first aid or emergency medical care that may be deemed necessary for my welfare. I understand that I am solely responsible for any and all charges for such health care services regardless of whether my medical insurance would cover such charges. I do certify that there is no medical reason which would prevent, or should prohibit, me from safely participating in the Event.   I hereby assign and grant to Rodale the right and permission to use and publish the photographs/films/videotapes/electronic representations and/or sound recordings made of me at all Rodale activities, and I hereby release Rodale from any and all liability for or from such use and publication. I hereby authorize the reproduction, sale, copyright, exhibit, broadcast, electronic storage, and/or distribution of said photographs/ films/videotapes/electronic representations and/or sound recordings without limitation at the discretion of Rodale, and I specifically waive any right to any compensation I may have for any of the foregoing.   I, the undersigned, am legally competent to sign this release. I have read the release, I understand its contents and I sign it voluntarily.   CANCELLATION POLICY   Entry fees are non-refundable and non-transferable under all circumstances, including, but not limited to, cancellation of the event or of your participation, or change in the date, nature, or format of the event. An event may be cancelled or changed due to severe weather or other factors that threaten the safety of participants, staff or volunteers. Event proceeds from your registration and fundraising efforts will still go to those in the metropolitan areas nearest to you.   Once we receive and accept your entry, you will not receive a refund if you cannot participate, you may not give or sell your race number to anyone else, and you may not transfer your entry fee to future races.   If you have questions regarding your registration please complete the "Contact Us" form at RUN10FEED10.com.   In the need of a cancellation 7 days prior to your event date your registration status can be changed to Run My Own 10K by using the "Contact Us" form at run10feed10.com.
