Because physical exercise can be strenuous and subject to risk of serious injury, Salina Regional Health Center (including Salina Regional Health Foundation, SRHC Service Auxiliary, and the Tammy Walker Cancer Center), and the Manhattan Running Company (“Race Director”) urge you to obtain a physical examination from a doctor before participating in the Fe for a Cure 5K race (“the Event”). You (each member, guest, and all participating family members) agree that you participate in the Event voluntarily and assume all risks of injury, illness, or death. Sponsors and Race Director are also not responsible for any loss of your personal property. IN SIGNING THIS RELEASE AND WAIVER YOU REPRESENT AND WARRANT, AS A CONDITION OF YOUR ENTRY AND PARTIPATION IN THE EVENT, THAT YOU ARE DOING SO STRICTLY IN ACCORDANCE WITH THE RECOMMENDATIONS OF YOUR PHYSICIAN; WILL TAKE ALL NECESSARY ACTIONS TO PARTICIPATE IN THE EVENT IN A SAFE MANNER; AND GIVE MEDICAL PERSONNEL PERMISSION TO TREAT YOUR INJURIES IF YOU ARE UNABLE TO MAKE THE DECISION FOR YOURSELF. This waiver and release of liability includes, without limitation, all injuries which may occur as a result of, (a) your participation in the Event, (b) injuries sustained as a result of contact with other Event participants, (c) Sponsors or Race Director instructions and supervision, and (d) your slipping and/or falling participating in the Event, including adjacent sidewalks and parking areas. You acknowledge that you have carefully read this “waiver and release” and fully understand that it is a release of liability and negligence. You expressly agree to and discharge Sponsors, Race Director, and all affiliates, employees, agents, representatives, successors, or assigns, from any and all claims or causes of action and you agree to voluntarily give up or waive any right that you may otherwise have to bring a legal action against them for personal injury or property damage. If any portion of this release from liability shall be deemed by a Court of competent jurisdiction to be invalid, then the remainder of this release from liability shall remain in full force and effect and the offending provision or provisions severed here from. By signing this release, I acknowledge that I understand its content and that this release cannot be modified orally.
