2024 COLLEGE SPORTS COMMUNICATORS 5K FUN RUN/WALK
WAIVER AND RELEASE OF LIABILITY
In consideration of participating in the College Sports Communicators 5K Fun Run/Walk on Monday, June 10, 2024, at the Mandalay Bay Resort in Las Vegas, Nevada, being sponsored by College Sports Communicators, I agree that I will not hold College Sports Communicators (“CSC”), National Association of Collegiate Directors of Athletics (“NACDA”), Mandalay Bay, LLC and its affiliates (“Mandalay Bay”) or their affiliates, agents, officers, employees or volunteers (collectively referred to herein as the "Released Parties") responsible for any injuries or losses I incur while participating in the College Sports Communicators 5K Fun Run/Walk. I am aware that this activity involves risks, including but not limited to: the dangers of colliding with other participants and objects, the dangers of surface hazards, or adverse weather conditions, and the risks inherent in any athletic activity or competition. I voluntarily assume full responsibility for any risks of loss or personal injury that may be sustained as a result of participating in the College Sports Communicators 5K Fun Run/Walk.
For myself, my heirs, executors, administrators, legal representatives, assignees, and successors in interest, I hereby release the Released Parties from any and all claims, liabilities, demands, damages, lawsuits, and other causes of action arising from my participation in the College Sports Communicators 5K Fun Run/Walk. I further agree to indemnify the Released Parties for any damage or harm I may cause any person or thing based on my participation in the College Sports Communicators 5K Fun Run/Walk.
I certify and represent that I am physically fit to participate in the College Sports Communicators 5K Fun Run/Walk. In the event of an illness, injury, or medical emergency, I authorize the Released Parties to provide or secure any treatment or transport deemed reasonably necessary for my immediate care. Furthermore, I agree that I will be responsible for the costs of any and all such care and transport.
I grant the Released Parties permission to use my photograph, picture, likeness, or voice in any media format whatsoever, and for any purpose whatsoever, including commercial advertising, and waive any compensation for such use. I agree to abide by all rules of the College Sports Communicators 5K Fun Run/Walk, and understand I may be removed from the course for violation of the rules, horse play or other inappropriate conduct.
If I am signing this WAIVER AND RELEASE OF LIABILITY on behalf of my minor child or ward, I authorize my minor child or ward to participate in the College Sports Communicators 5K Fun Run/Walk, and make all representations and agreements contained herein on behalf of my minor child or ward and agree my minor child or ward shall be bound by all terms of this WAIVER AND RELEASE OF LIABILITY.
Terms of this WAIVER AND RELEASE OF LIABILITY are severable; if any one or more of the terms herein is found to be unenforceable or invalid by a court of competent jurisdiction, the other terms herein shall not be affected and shall remain binding and enforceable. The representations and agreements I have made in this WAIVER AND RELEASE OF LIABILITY are binding on me, my heirs, executors, administrators, legal representatives, assignees, and successors in interest. I understand that the Released Parties are relying on the representations and agreements made herein. I understand that all entry fees (if applicable) are non-refundable.
I acknowledge and represent that I have read the foregoing, understand it and sign it voluntarily as my own free act; I am at least eighteen (18) years of age and fully competent.
