RELEASE OF LIABILITY
I, the undersigned participant (“Participant”) am aware that participation in running events and related activities may result in accident or injury and participant assumes the risks connected with participation in said activities. Participant hereby represents that participant is in good health and does not suffer from any physical impairment which would affect participant’s ability to be involved in running or related activities. Participant acknowledges and is aware that FITniche Events has not and will not render any medical services including medical diagnosis of participant’s physical condition. In consideration of being permitted to participate, participant, for himself/herself and his/her personal representatives, heirs and next of kin, releases, waives, discharges and covenants not to sue FITniche Events, its officers and members, The City of Lakeland, Lakeland Country Club, owners and lessees of the premises, each of them their officers and employees, all referred to as releases, from all liability to and any claim or damage therefore on account of any injury to the person or property of the participant or resulting in the death of the participant whether caused by the negligence of the releasees or otherwise, while participant is participating in a running event or any related activity, to include getting to and from the running event. Participant agrees to indemnify the releasees and each of them from any loss, liability, damage or costs releasees may incur due to the presence of participant in any scheduled running event whether caused by the negligence of releasees or otherwise. Participant assumes full responsibility for and risk of bodily injury, death or property damage due to negligence of releasees or otherwise while participating in a running event or related activity associated with FITniche Events. Participant agrees that this Release, Waiver and Indemnity Agreement is intended to be as broad and inclusive as permitted by the laws of the State of Florida and that if any portion of the Agreement is held invalid, it is agreed that the balance shall, not withstanding, continue in full force and effect. Participant, being of lawful age, in consideration of being permitted to participate in running events and related activities at or associated with FITniche does for himself/herself and his/her heirs, executors, administrators, and assigns hereby release and forever discharge FITniche Events, its officers, directors, shareholders, and employees, their heirs, administrators and executors of any and from any and every claim, demand, action, or right of action, of injury or personal injuries known or unknown, death, and/or property damage resulting from any incident which may occur as a result of participation in running events or related activity associated with or at FITniche Events, whether by negligence or not. Participant further states that he/she has carefully read the above Release and knows the contents of the Release and signs this Release as his/her own free act. Participant further releases any and all employees, officers, directors, and shareholders from any claim whatsoever on account of rendering first aid, treatment or services rendered during his/her participation in running events or related activity associated with or at FITniche Events. This Release contains the entire agreement between the parties to this agreement and the terms of this Release are contractual and not a mere recital.
SAFETY
Course is NOT closed! You must obey all traffic laws, including running against traffic if you are in the road. Look both ways before crossing or entering any street or parking lot. Wear bright or reflective clothing and lights in the dark. Do not allow minors to run unaccompanied. Smile and be courteous to others, including drivers. Allow ample room for other runners and vehicles to pass you. Assist any other runner or walker who appears in distress and report immediately to 911.
COVID
As it applies to my participation in this race (event), I agree to abide by the Center for Disease Control (CDC)'s recommendations for the prevention of the spread of COVID-19 and attest to having read the CDC's guidance at: https://www.cdc.gov/coronavirus/2019-ncov/prepare/prevention.html. I also agree to abide by any COVID-19 distancing and other safety guidelines issued by the state, the community or by this race (event) for my participation in this race (event).”
In consideration of you accepting this entry, I, the participant, intending to be legally bound do hereby waive and forever release any and all rights and claims for damages or injuries that I may have against the Event Director, RunSignup.com, and all of their agents assisting with the event, sponsors and their representatives, volunteers and employees for any and all injuries to me or my personal property. This release includes all injuries and/or damages suffered by me before, during or after the event. I recognize, intend and understand that this release is binding on my heirs, executors, administrators, or assignees.
I know that running a road race is a potentially hazardous activity. I should not enter and run unless I am medically able to do so and properly trained. I assume all risks associated with running in this event including, but not limited to: falls, contact with other participants, the effects of weather, traffic, and course conditions, and waive any and all claims which I might have based on any of those and other risks typically found in running a road race. I acknowledge all such risks are known and understood by me. I agree to abide by all decisions of any race official relative to my ability to safely complete the run. I certify as a material condition to my being permitted to enter this race that I am physically fit and sufficiently trained for the completion of this event and that a licensed Medical Doctor has verified my physical condition.
In the event of an illness, injury or medical emergency arising during the event I hereby authorize and give my consent to the Event Director to secure from any accredited hospital, clinic and/ or physician any treatment deemed necessary for my immediate care. I agree that I will be fully responsible for payment of any and all medical services and treatment rendered to me including but not limited to medical transport, medications, treatment and hospitalization.

I also agree to abide by any COVID-19 distancing and other safety guidelines issued by the state, the community or by this race for my participation in this race.
Further, I grant permission to all the foregoing to use my name, voice and images of myself in any photographs, motion pictures, results, publications or any other print, videographic or electronic recording of this event for legitimate purposes.
This event follows the standard running industry policy: All entry fees are non-refundable. We reserve the right to postpone or cancel the event due to circumstances beyond our control such as a natural disaster or emergency or as required to protect the safety of participants and staff. No refunds will be issued under these circumstances. We reserve the right to change the details of the event without prior notice. I understand that my entry fee is nonrefundable and bib numbers are non transferable.
By submitting this entry, I acknowledge (or a parent or adult guardian for all children under 18 years) having read and agreed to the above release and waiver including the no refund policy.
