LIABILITY WAIVER

EVENT: Carillon Classic 5k

EVENT DATE: March 12th, 2022

I understand that my participation in the Event offered by Bok Tower Gardens involves the risk of injury to me, which may result from not only my own actions, inactions, or negligence, but also from the actions, inactions, or negligence of others participating in the Event, the condition of the facilities, equipment or areas where the Event is being conducted, and/or the rules of play or requirements of the Event I hereby release, hold harmless, and indemnify Bok Tower Gardens and its agents, employees, officers, and directors from any and all liability, costs, expenses, claims, and settlements, including, but not limited to, attorneys’ fees and expenses, arising out of my participation in the Event.

I certify that I am in good health and have no physical condition that would prevent my participation in the Event. I consent to emergency medical treatment if required during the Event. I agree to uphold the mission, vision, and values of Bok Tower Gardens while participating in the Event, which includes a prohibition on the use of inappropriate language and the use of alcohol during the Event.

I understand that Bok Tower Gardens may use photographs, digital images, slides, movies, video tape, and/or other media coverage (“Media”) of Event participants (including me) and spectators to publicize and promote Bok Tower Gardens or any of its affiliates. I agree that any such Media of me may be taken in connection with my participation in the Event without compensation to me. I hereby waive any rights I may have in such Media and consent to its use by Bok Tower Gardens for any legal purpose.

I have read this Waiver and understand the terms used in it and their legal significance. This Waiver is freely and voluntarily given by me with the understanding that my right to recourse against Bok Tower Gardens is knowingly given up by me in return for Bok Tower Gardens’ allowing my participation in the Event. I hereby certify that by participating in this event it binds my successors, heirs, representatives, administrators, and assigns. This Waiver shall be construed broadly to provide a release and waiver to the maximum extent permissible under the applicable law.
