Warning of Risk & Injury: You are solely responsible for determining if you or your minor/ward is physically fit and/or adequately
skilled for road race participation. It is always advisable, especially if the participant is pregnant, disabled in any way or recently
suffered illness, injury, or impairment, to consult a physician before undertaking any physical activity. You are also solely responsible
for selecting and wearing personal protective equipment. Please recognize that roadways are maintained and intended for motor
vehicles use and not pedestrian use. Therefore, surface irregularities and other hazards that do not pose safety risks to motor vehicles, may pose risks to joggers and walkers. Prior to the event, all participants should familiarize themselves with traffic patterns, check points and all first aid and water stations. Most importantly, remember that this is a voluntary recreational activity. Never compromise your safety in the name of competition.
Warning of Risk: Running and power walking are intended to challenge and engage the physical, mental, and emotional resources of each participant. However, despite careful and proper preparation, instruction, medical advice, conditioning, and equipment; there is still a risk of serious injury, including death. Understandably, not all hazards and dangers can be foreseen. The very nature of road racing is hazardous and risky, including but not limited to overexertion, dehydration, slip and falls, collision with other participants, the effects of weather, dangerous conditions of the road, being struck by a vehicle or bicycle, lack of good physical conditioning, poor training technique, and all other circumstances inherent in running/walking events. In this regard, it must be recognized that it is impossible for the Westchester Park District to guarantee absolute safety.
Waivers & Release of all Claims, Assumptions of Risk: Please read this form carefully and be aware that in signing up and
participating in this event, you will be expressly assuming the risk of legal liability and waiving and releasing all claims of injuries,
damages, or loss which you or your minor child/ward might sustain as a result of participating in any and all activities connected with
and associated with this event. As a participant in the Hero Hustle 5K Run, I recognize and acknowledge that there are certain risks of
physical injury, and I voluntarily agree to assume the full risk of any injuries, including death, damages, or loss, regardless of severity
that my minor child/ward or I may sustain as a result of participating in any and all activities connected with or associated with this event. I further agree to waive and relinquish all claims against the Westchester Park District, and all sponsors, their respective officers, agents, servants, volunteers, and employees (Hereinafter, collectively referred to as the “Event Sponsor”) which I or my minor child/ward may have (or accrue to me or my minor child/ward) as a result of participating in the event. I do hereby fully
release and forever discharge the Event Sponsors from all claims for injuries, including death, damages, or loss which I or my minor
child/ward as a result of, arising out of, connected with, or in any way associated with this event. I further agree to indemnify and
hold harmless and defend the Event Sponsor from all claims resulting from injuries, including death, damages and losses sustained by me or my minor child/ward and arising out of, in connection with, or in any way associated with the activities of this event.
Right to Cancel: Postpone or Alter the Event: I am aware that the Westchester Park District reserves the right to cancel, postpone or
alter the event, and the Event Sponsor assume no liability in the case of any said cancellation, alteration, or postponement of this
event for any reason. I further understand that entry fees are non-transferable and non-refundable for any reason, including in the
event of cancellation, alteration of postponement of the event.
Photo/Video Authorization, Consent and Release of Claims: Further, I hereby authorize and give my consent to the Event Sponsor to photograph/ video myself and my child/ward and without limitation, to use such photographs/video in connection with
promoting/advertising the services, programs, and facilities of the Westchester Park District, including, but not limited to
Westchester Park District‘s websites and sponsored social media site(s), without consideration of any kind. Such productions may be
copied, copyrighted, edited, and distributed by the Westchester Park District in the manner described above. I understand tha t my
or my child’s/ward’s name, likeness or voice maybe used in a manner described above, and grant the Event Sponsor the right to use or reuse, in any manner at all, the video, motion picture, audio recording, web page, or still photograph productions, and broadcasts as described above. I hereby forever release and discharge the Event Sponsors from all claims, actions and demands arising out of or in connection with the use of said video, motion picture, audio recording web page, or still photography, including without limitation, all claims for invasion of privacy and libel. This release shall insure to the benefits of the assignments, licenses, and legal representation of the Event Sponsor, as well as the party(ies) for whom the Event Sponsor took the video, motion picture, aud io recording, web page or still photography.
I have read and fully understand the program details, warning of risk, assumption of risk, and waiver and release of all claims. If
registering online or via fax, your online or facsimile signature shall substitute for and have the same legal effect as an original form
signature. Race entry is nonrefundable. One runner per application. No roller blades, bikes, or dogs allowed.
