In consideration of the permission granted to me to enter onto the premises and participate in the aforementioned activity, I hereby, for myself, my heirs and administrators, assign, release, remise and discharge the owners, operators and sponsors of the premises, activities, and equipment thereon and their respective servants, agents offices and all other participants in the stated activities of and from all claims, demands, actions and causes of any sort for injury sustained to my person and/or property during participation in stated activities due to negligence or any other fault. The activity for which you are registering (the “Event”) is physically challenging and pose a risk of discomfort, illness, injury, and even death. You need to be satisfied that you are physically capable of doing the Event without risk to your health or your life. We do not conduct health or fitness checks on entrants. While we take care to make the Event as safe as possible, we cannot remove risks and dangers to participants and observers and, accordingly, you participate or observe at your own risk. Please confirm for the Village of Los Lunas to take photos during the event to be used in print or electronic publications and advertisements produced by the Village of Los Lunas or in news stories produced by outside television or print news organizations.

Waiver of Liability Form

Assumption of the Risk and Waiver of Liability Relating to Coronavirus/COVID-19

The novel coronavirus (“COVID-19”) has been declared a worldwide pandemic by the World Health Organization. COVID-19 is extremely contagious and is believed to spread mainly from person-to-person contact. As a result, federal, state, and local governments and federal and state health agencies recommend social distancing and have, in many locations, prohibited the congregation of groups of people. The Village of Los Lunas Parks & Recreation Department (hereafter “The Village”) has put in place preventative measures to reduce the spread of COVID-19; however, cannot guarantee that you will not become infected with COVID-19. Further, attending any program or activity at the Daniel Fernandez Recreation Center or any Village of Los Lunas Facility could increase your risk of contracting COVID-19. By signing this agreement, I acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that I may be exposed to or infected by COVID-19 while attending the Village sponsored program and that such exposure or infection may result in personal injury, illness, permanent disability, and death. I understand that the risk of becoming exposed to or infected by COVID-19 at the Village sponsored program may result from the actions, omissions, or negligence of myself and others, including, but not limited to, Village employees, volunteers, and program participants and their families. I voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury to myself (including, but not limited to, personal injury, disability, and death), illness, damage, loss, claim, liability, or expense, of any kind, that I may experience or incur in connection with my attendance at the Village sponsored event or (“Claims”). On my behalf, I hereby release, covenant not to sue, discharge, and hold harmless the Village of Los Lunas, its employees, agents, and representatives, of and from the Claims, including all liabilities, claims, actions, damages, costs or expenses of any kind arising out of or relating thereto. I understand and agree that this release includes any Claims based on the actions, omissions, or negligence of the Village of Los Lunas, its employees, agents, and representatives, whether a COVID-19 infection occurs before, during, or after attending any Village program or activity. 

Additionally, I consent to any safety procedures that the Village has already or may in the future put into place including but not limited to, temperature checks, mask requirement, contact tracing, and social distancing, and any refusal or noncompliance to these procedures will result in mine and my entire team’s immediate removal from the league without refund.

By registering for this program, I agree to a no refund policy due to COVID related reasons.
