By indicating your acceptance, you understand, agree, warrant and covenant as follows:
For and in consideration of the acceptance of my entry in the One Team ATL 5K to be held on July 11 and July 12, 2020. I attest that I am physically fit, have sufficiently trained for and am mentally and physically capable of participating in this road race event. My participation is voluntary and is done at my own risk. I understand that participation in running events is an inherently dangerous activity and that risks of participating include, but are not limited to, death and serious bodily injury. I assume all risks associated with participating in this event including, but not limited to, the weather, to include high heat and humidity, conditions of the road and other race area surfaces, falls, collisions, motor vehicle traffic, the conduct of spectators and other runners, the possibility of exposure to viruses or illness of any kind. I hereby, for my myself, my heirs, my administrators and executors, personal representative and my assigns forever waive, release and discharge any and all rights and claims for damages or losses, whether monetary or otherwise compensatory, that I may have against: (i) the Atlanta Track Club; (ii) City of Atlanta and Fulton County Recreation Authority, City of Atlanta, Georgia, Fulton County, Georgia; (iii) Atlanta National League Baseball Club, LLC and Atlanta Braves Foundation, Inc.; (iv) Atlanta Falcons Football Club, LLC and Atlanta United Football Club, LLC; (v) ATL Hawks, LLC; (vi) Dream Too, LLC; (vii) the MLB Entities defined as the office of the Commissioner of Baseball, its Bureaus, Committees, Subcommittees and Councils, the Major League Baseball Clubs, MLB Advanced Media, L.P., Major League Baseball Properties, Inc., The MLB Network, LLC, Tickets.com, LLC, each of their parent, subsidiary, affiliated and related entities, any entity which, now or in the future, controls, is controlled by, or is under common control with the foregoing entities and the owners, general and limited partners, shareholders, directors, officers, employees and agents of the foregoing entities all other sponsors of the race; and (viii) each of their respective parent, subsidiary and affiliated companies, and all of their respective directors, officers, shareholders, employees, members, representatives, agents, independent contractors, sponsors, successors and assigns, and any of the Event’s (and the Events’ ancillary events) officials, participants, organizers, planners, and volunteers (collectively, the “Indemnified Parties”) for any injuries or illnesses sustained by me arising out of my association with, entry in, or participation in the and any pre-, post-, or other race related activity. I understand and agree that medical or other services rendered to me by or at the instance of any of the above indemnified parties is not an admission of liability to provide or continue to provide any such services and is not a waiver by any said indemnified parties of any right hereunder. I also acknowledge that should I require transport to a medical facility, I must pay for such transportation and any treatment provided. I further agree now and forever to hold the above named and unnamed indemnified parties harmless and indemnify, and covenant not to sue them for all claims, damages, judgments, and costs of whatever nature and form. I agree to abide by all instructions from race officials and I agree to withdraw from the race if such official in his or her judgment and discretion determines that I should not participate including because my participation poses a threat to the safety of myself or others or because I did not abide by any instruction given to me. I understand and will abide by the rule that for safety, no wheeled vehicles or wheeled means of conveyance are permitted in the footrace. I grant permission to the Atlanta Track Club and others to use any photographs, videotapes, motion pictures, recordings, social media postings or any other record of me and/or this event for any legitimate purpose. I also grant permission for the Atlanta Track Club to contact me by email for race-related communications. I understand that the race entry fees paid by or for me are nonrefundable. The no refund policy applies to any cancellation of the race for weather or other circumstances as deemed appropriate by the official race director. NUMBERS FOR THE One Team ATL 5K AND ITS ANCILLARY EVENTS ARE NOT TRANSFERABLE.
(v) I hereby acknowledge and understand that the World Health Organization has declared COVID-19 a worldwide pandemic. COVID-19 is extremely contagious and spreads mainly from person-to-person contact. Based on currently available information and clinical expertise, older adults and people of any age who have serious underlying medical conditions may have a higher risk for severe illness from COVID-19. There have been recommended guidelines and preventative measures put in place to reduce the spread of COVID-19; however, it CANNOT GUARANTEE that I will not become exposed to or infected with COVID-19, despite reasonable efforts to mitigate such dangers. Furthermore, my participation in this Event could increase my risk of contracting COVID-19. By signing this Agreement and participating in the Event, I acknowledge the extremely contagious nature of COVID-19 and voluntarily assume the risk that I may be exposed to or infected with COVID-19 from the Event, and that such exposure or infection may involve the RISK OF SERIOUS INJURY, ILLNESS, PERMANENT DISABILITY AND/OR DEATH. I understand that the risk of becoming exposed to or infected with COVID-19 by my participation in the Event may result from the actions, omissions, or negligence of others and/or myself, including, but not limited to, the Indemnified Parties. I hereby expressly assume all such risks and dangers whether presently known or unknown, and hereby release, waive and forever discharge each of the Indemnified Parties from any and all actions, causes of action, claims, suits, debts, dues, sums of money, bonds, bills, balances, losses, costs, expenses, damages, covenants, agreements, commitments, undertakings, promises, liabilities, obligations, lawsuits, judgments, orders and demands whatsoever, in law, at equity or otherwise, of whatever kind or nature, whether known or unknown, suspected or unsuspected, asserted, accrued, unaccrued, actual, contingent, or otherwise, direct or indirect and whether or not concealed or hidden arising out of, on account of or relating to any INJURY TO OR RESULTING IN DEATH (including but not limited to INJURY TO OR RESULTING IN DEATH FROM COVID-19) of myself arising out of or related to my participation in the Event.
