ACCESS AGREEMENT & PERMIT
Activity/ Activities: Gunstock Trails half marathon and 5k race

THE PERMIT APPLICANT DOES HEREBY AGREE TO THE FOLLOWING:
1. I understand that I am accessing and using private property free of charge, at my own risk. In exchange for this benefit, I hereby agree that I will defend and hold harmless Hawaii Reserves, Inc., Property Reserves, Inc., and its affiliates (referred to here after as “HRI”), for any liability, injury, loss or damage, whether caused by natural condition, improved conditions, or other users and activities, including other permitted guests and unpermitted trespassers and activities.
2. I understand that I am accessing private property knowing that potentially unsafe conditions exist on the property, either as a result of the natural conditions of the land, improved conditions, or other users and activities, including permitted guests and unpermitted trespassers and activities. I do so at my own risk and agree as explained above to defend and hold HRI harmless.
3. I will engage only in the permitted activity or activities listed above while on property. I will not engage in the use of firearms, weapons, combat sport equipments (such as paintball or air soft shooting), or motorized vehicles unless expressly authorized by separate permit.
4. I will not smoke, use illegal drugs, or consume alcohol on the property. I will obey all laws and conduct myself in an orderly manner.
5. I am responsible for the cleanup of the area used. I will be responsible for any damage done to the property and/or facilities, and hereby agree to reimburse HRI for any damages or loss resulting from my use.
6. I understand and agree that this permit may be canceled at anytime by HRI and that it - and the Access Agreement & Permit Card issued to me (if applicable) - must be kept in my possession at all times while on property for authorization purposes.
7. This is a legally binding document. I have read, understand, and agree to the above terms and conditions, and have been given the opportunity to ask questions for clarification purposes.

oad race is a potentially hazardous activity.   I should not enter and run unless I am medically able and properly trained to complete the event.  I agree to abide by any decision of a race official relative to my ability to safely complete this run within the designated time limit.  I assume all risks associated with running in this race, including, but not limited to falls, contact with other participants, runners, bikers, horses and other animals, the effects of weather, including heat or cold and precipitation, mud, traffic, and the conditions of the trails and roads, all such risks being known and appreciated by me.  Having read this waiver and knowing these facts and in consideration of your accepting my entry, I for myself and anyone for whom I am entitled to act, waive, release, and will hold harmless the Gunstock race organizers and all other sponsors and property owners, and all the agents, employees, officers, directors and volunteers working for those entities from all claims and liabilities of any kind arising out of or related to my participation in this race.
