Waiver: As a registered participant in the event known as WORKZONE 5K RUN (hereinafter, “Run”), I hereby certify that I am in good health and medically able and properly trained to perform in this event.  I acknowledge that running a road race and participating in the Run is potentially hazardous activity, which could cause injury or death.  I acknowledge that the Missouri Highways and Transportation Commission or Missouri Department of Transportation,  St. Louis County Department of Transportation, Missouri Highway Patrol, St. Louis County Police, Civil Design Inc., Millstone Weber, Bussen Quarries, all event sponsors, all event coordinators, and Big River Running (hereinafter, “Released Entities”) make no warranties as to the condition of, or safety of anything known or unknown on the property upon which I will enter as a participant in the Run, and specifically disclaim such warranties.  I hereby shall knowingly and voluntarily participate in the Run and enter the property at my own risk and I hereby acknowledge and assume all risks associated with running in the Run, including by not limited to: falls, contact with other participants, the effects of the weather, including high heat and/or humidity, traffic and the conditions of the road, all such risks being known and appreciated by me.  I, voluntarily and knowingly, for myself and for my heirs, successors, guardians, executors, agents, and assigns, hereby fully forever remise, release, quitclaim, and discharge the Released Entities, their predecessors, successors, assigns, and all of their past, present and future officials, commissioners, employees, agents, counsel, and servants whether or not known as well as all persons, or organizations in privity with the Released Entities from any and all actions, causes of action, damages, claims, liability, responsibility, and demands whatsoever, in law or in equity, or otherwise, arising out of or in connection with my participation in the run.  This release includes, but is not limited to, all actions, errors, or omissions, whether negligent or not, of the Released Entities, their predecessors, successors, assigns, and all of their past, present and future officials, commissioners, employees, agents, counsel, and servants whether or not known as well as all persons, or organizations in privity with the Released Entities.  In addition to the above-referenced general release, which is to be construed as broadly as possible to the fullest extent of the law, I hereby fully forever remise, release, quitclaim, and discharge the Missouri Highways and Transportation Commission and Missouri Department of Transportation from all liability under Chapter 537 RSMo, including, but not limited to 537.6000 RSMo, for any and all known or unknown flaws, deterioration, or disrepair of the Missouri Highways and Transportation Commission’s property.  I agree to be responsible for all of my actions, errors, or omissions, whether negligent or not, during my participation in the run and I agree to indemnify each Released Entity if any said Release Entity is held responsible in any way for any of my actions and to hold each Released Entity harmless for same.  I do hereby irrevocably authorize the Release Entities to edit, copy, exhibit, publish, or distribute my name and likeness for any lawful purpose without payment or any other consideration.  I do hereby hold harmless and release the Released Entities from any and all claims I may have by reason of the publication of my name or video and/or pictures of myself, in whole or in part, or of any statements from me which are truthfully and accurately quoted for newsworthy or other informational purposes.  This Release may be pleaded as a full and complete defense to any subsequent action or other proceeding arising out of, or relating to, or having anything to do with, any and all claims, counterclaims, issues, defenses or other matters released and discharged by this Release.  It is my intention that this Release, which I knowingly and voluntarily execute, be binding on my heirs, successors, guardians, and assigns.
