1. I understand, accept, and assume the risks involved in the Ride.  
a. I acknowledge, agree and represent that I understand the nature of the Ride and that I am qualified, in good health, and in proper physical condition to participate in the Ride.  I further agree and warrant that, if at any time I believe my continued participation in the Ride to be unsafe, I will immediately discontinue further participation in the Ride.

b. IF APPLICABLE: I acknowledge, agree and represent that my participation in the Ride is voluntary, does not constitute any part of my job duties or responsibilities for VAMAC, Inc., is not and shall not be considered a condition of my employment with VAMAC, Inc., and is not and shall not be considered within the course and/or scope of my employment with VAMAC, Inc.  I also acknowledge that my participation in the Race does not arise from or satisfy any express or implied duties of employment with VAMAC, Inc.  I further acknowledge, agree and understand that any injury that may occur to me as a result of my participation in the Ride will not be covered by worker’s compensation insurance or any other insurance policy held by VAMAC, Inc.    

c. I fully understand that my participation in the Ride involves risks and dangers of accident, loss, damage, personal injury, and illness, including permanent disability, paralysis, and death (the “Risks”).  I fully understand that the Risks could be caused by multiple factors including, but not limited to, me, other participants in the Ride, equipment failure or malfunction, inclement weather conditions, variation of the riding surfaces, and other environmental conditions.  I fully assume all of the Risks associated with my participation in the Ride and all responsibility for losses, costs, and damages I incur as a result of my participation in the Race, including the possibility of personal injury, death, property damage, or loss resulting therefrom.
  
d. Although I understand that a physician’s examination is not a requirement of my participation in the Ride, I understand that it is highly recommended that I consult with a physician before participating in the Ride.  

2. By the execution of this agreement, I accept and assume full responsibility for any and all injuries, damages (both economic and non-economic), and losses of any type, which may occur to me, and I hereby fully and forever release and discharge the Sponsors, their insurers, employees, officers, directors, and associates, from any and all claims, demands, damages, rights of action, or causes of action, present or future, whether the same be known or unknown, anticipated, or unanticipated, resulting from or arising out of my participation in the Ride. 
  
3. I expressly agree to indemnify and hold the Sponsors, their parent and subsidiary companies and organizations, and such entities’ directors, officers, employees, shareholders, and other agents harmless against any and all claims, demands, damages (including attorneys’ fees and costs), rights of action, or causes of action, of any person or entity, that may arise from injuries or damages sustained or caused by me.  

4. I agree to be solely responsible for my safety and well-being during my participation in the Ride.  I also agree to comply with all rules, regulations, and procedures regarding the Ride.   

5. IF APPLICABLE: I am hereby applying for my child to participate in the Ride and represent and warrant that I am the parent or legal or natural guardian of such child.  I hereby consent to my child’s participation in the Ride and agree and acknowledge that the terms of this document apply equally to my child.  I fully and forever release and discharge the Sponsors, their insurers, employees, officers, directors, and associates, from any and all claims, demands, damages, rights of action, or causes of action, present or future, whether the same be known or unknown, anticipated, or unanticipated, resulting from or arising out of my child’s participation in the Ride.   I also agree to indemnify and hold the Sponsors, their parent and subsidiary companies and organizations, and such entities’ directors, officers, employees, shareholders, and other agents harmless against any and all claims, demands, damages (including attorneys’ fees and costs), rights of action, or causes of action, of any person or entity, that may arise from injuries or damages sustained or caused by my child.   

6. Every term and provision of this agreement is intended to be severable.  If any one or more of them is found to be unenforceable or invalid, such finding shall not affect the other terms and provisions, which shall remain binding and enforceable.  

I HAVE READ THE FOREGOING WAIVER AND RELEASE OF LIABILITY AND VOLUNTARILY EXECUTED THIS DOCUMENT WITH FULL KNOWLEDGE OF ITS CONTENT.
