WAIVER FOR THE 5K AT FONTANEL & FAMILY GAMES - THE FONTANEL - JUNE 16, 2018 - NASHVILLE, TN -
By registering for and/or attending THE 5K AT FONTANEL & FAMILY GAMES ON JUNE 16, 2018 (i.e., "this Event", "the Event" and/or "Event"), I (we) (or a parent or adult guardian or person(s) in supervisory positions) for all children under 18 years), acknowledge and agree that:
REGISTRATION: (1.) EVERYONE MUST BE REGISTERED to enter the grounds (without exception and regardless of age, including infants). (2.) I (we) also acknowledge and agree that: Registration for this Event may be made together or separately; or as a spectator and that children ages 6 and under may watch the 5K and watch/play/compete in the Games for free and spectators (ages 7 and above) are welcome to watch the 5K and the Games for a small entrance fee.
FAMILIES/GROUPS/TEAMS: (3.) Families/groups/teams of 4 or more get a 25% discount on their registrations by using coupon code 25OFF on the payment page but merchandise is excluded. (4.) Groups/teams may be created/joined during registration (online and/or walk-up) but are NOT required.
T-SHIRTS: (5.) Only registered and paid 5K race and/or Family Games participants will receive a free t-shirt but additional t-shirts (along with upgrades to Dri-Fit t-shirts) may be purchased by anyone but t-shirts purchased for The Games are not guaranteed after June 10th. Final t-shirt design/logo/colors may be different than presented or advertised.
DOOR PRIZES: (6.) The chance to win a door prize at the conclusion of Event is conditional on my (our) being present in person for the drawing and the prizes are limited to only one chance per paid registration which may be drawn at random.
CONDUCT & CLOTHING: (7.) I (we) agree that I (we) will conduct myself/ourselves in a courteous and professional manner at all times and will abide by all the policies, rules, terms and conditions of the Event (and also of the State of Tennessee) and will only use appropriate and modest language and wear appropriate and modest clothing which do not have offensive or provocative wording/images as determined by the Event Director.
PHYSICAL ABILITIES: (8.) I (we) understand and agree that running a trail race and participating in competitive games can be a potentially hazardous activity and understand that I (we) should not enter/participate unless medically able to do so and are properly trained. (9.) I (we) agree that all such risks are known and understood and assume all risks associated with running/participating in this Event including, but not limited to: falls; contact with other participants; the effects of weather; traffic; event conditions. (10.) I (we) waive any and all claims which might be based on any of those and other risks typical found in running/competing/participating in this Event and I (we) agree that I (we) will abide by all decisions of any Event official relative to my (our) ability to safely complete the Event and certify as a material condition to my (our) being permitted to enter this Event that I (we) am (are) physically fit and sufficiently trained for the completion of this Event and that a licensed Medical Doctor has verified my (our) physical condition.
MEDICAL EMERGENCIES: (11.) I (we) agree in the event of an illness, injury or medical emergency arising during the Event, I (we) do hereby authorize and give consent to the Event Director or other Event representative to secure from any accredited hospital, clinic and/or physician any treatment deemed necessary for my (our) immediate care and agree to be fully responsible for payment of any and all medical services and treatment rendered including but not limited to medical transport, medications, treatment and hospitalization.
IMAGE & LIKENESS: (12.) I (we) grant permission to all the foregoing to use my (our) name(s); voice(s); image(s) and likeness(es) in any photographs; videos; motion pictures; results; publications; print; videographic or electronic recording/presentation of this Event for purposes as determined by the Event Director or other Event representative.
RIGHTS & CLAIMS: (13.) I (we) are legally bound and hereby waive and forever release any and all rights and claims for damages or injuries that I (we) may have against the Event; Event Director; Event representatives; and all of their agents assisting with the Event; sponsors and their representatives; Family Foundation Fund and their representatives; ChronoTrack.com/Athlinks and their representatives; The Fontanel Company and their representatives; volunteers; staff; employees; and/or anyone else associated with the Event; for any and all injuries or personal property and agree this release includes all injuries and/or damages suffered by me (us) before, during or after the Event and recognize, intend and understand that this release is binding on my (our) heirs, executors, administrators, or assignees.
LITIGATION: (14.) In the event that litigation is required for any/every reason, I (we) agree that all legal/business proceedings will be conducted in/around the city of Nashville, TN, USA at my (our) expense including all court costs/fees/billings/etc.
WEBSITES/SOCIAL MEDIA: (15.) I (we) also agree that the use of this site (and all websites associated with this Event) to inquire/comment/suggest/register for said Event is subject to "Terms of Use" by The Fatherhood Games; Family Foundation Fund; and ChronoTrack.com/Athlinks (i.e. these "terms") and that I (we) understand that these terms may be modified at any time without notice. (16.) I (we) agree that the use of this site constitutes a binding acceptance of these terms by me (us) including any modifications and I (we) also agree not to post any offensive or objectionable content and bear all risks associated with entering/posting such content. (17.) I (we) also agree that I (we) assume all liability for taking these actions and agree The Fatherhood Games; Family Foundation Fund; and ChronoTrack.com/Athlinks has the right but not the obligation to post, refuse to post, edit or delete any content submitted with sole discretion at any time and for any reason without giving any notice and disclaim any responsibility for the deletion, failure to store or post any content submitted.
WARRANTIES: (18.) I (we) also understand and agree that no warranty is implied that said sites will not be uninterrupted or error free and there is no warranty as to the contents/facts/timeliness; and there will be no liability on the part of The Fatherhood Games; Family Foundation Fund; and ChronoTrack.com/Athlinks; nor any of it's representatives; for any direct, incidental, special or consequential damages out of use of said sites.
