By indicating your acceptance, you understand, agree, warrant and covenant as follows:2017 ST PETE RUN FEST DISCLAIMERIn consideration of my entry being accepted in the St. Pete Run Fest Half Marathon, 5K, and/or Kids K, I, intending to be legally bound, do hereby, for myself, my heirs, executors, and assigns, waive, release and forever discharge any and all rights and claims for damages that I may have or which may hereafter accrue to me against Endorfun Sports LLC, the City of St. Petersburg, Pinellas County, imAthlete and/or any subsidiary or political subdivision thereof, its or their respective officials, agents, representatives, successors, assigns, volunteers and sponsors for any and all damages that may be sustained and suffered by me in connection with my association with or entry or participation in the St Pete Run Fest events. I know that participating in a St Pete Run Fest Event is a potentially hazardous activity. I should not enter and participate unless I am medically able and properly trained. I understand that a physical examination is not required to qualify to run/walk this event and that all competitors participate at their own risk. (If in doubt as to your physical condition to engage in an event as strenuous as these races, it is strongly recommended that you seek the advice of a competent physician). I agree to abide by any decision of a race official relative to my ability to safely complete the run, however, I also acknowledge that race officials are not responsible to know my medical condition, or my ability to participate in and complete this event. I assume all risks associated with participating in St Pete Run Fest weekend activities including, but not limited to falls; contact with other participants, volunteers and spectators; the effects of the weather, including high heat and/or humidity; traffic and the conditions of the road;, and holes and obstructions along the route, all such risks being known and appreciated by me. I also hereby consent to permit emergency medical treatment needed, as determined by race medical personnel in the event of injury or illness, and waive the right to hold those personnel accountable for any adverse effects that should arise from said treatment. I also understand that in the event these races cannot be held as scheduled because of an act of God or circumstances beyond their control, the race is not liable to refund any money paid by me to participate. I release the rights to any and all photographic material (including video) that Endorfun Sports LLC may wish to release for this event without obligation to me.All persons under 18 years of age must have written consent of parent or legal guardian to compete in the above mentioned events. I, the undersigned parent or guardian, hereby consent to the applicant's participation and waive and release all rights and claims for damages as is more fully set forth above. The Top 25 overall men and women agree to drug testing in accordance with The USA Track and Field and IAAF Rule 144.BY INDICATING YOUR ACCEPTANCE OF THIS AGREEMENT AND WAIVER, YOU ARE AFFIRMING THAT YOU HAVE READ AND UNDERSTAND THIS AGREEMENT AND WAIVER AND FULLY UNDERSTAND ITS TERMS. YOU UNDERSTAND THAT YOU ARE GIVING UP SUBSTANTIAL RIGHTS, INCLUDING THE RIGHT TO SUE. YOU ACKNOWLEDGE THAT YOU ARE SIGNING THE AGREEMENT AND WAIVER FREELY AND VOLUNTARILY, AND INTEND BY YOUR ACCEPTANCE TO BE A COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILITY TO THE GREATEST EXTENT ALLOWED BY LAW.
