In consideration of permission granted by the University of Southern Indiana allowing me to participate in the USI Doggie Dash (the “Event”), which is sponsored by Romain Subaru and presented by the Pott College of Science, Engineering, and Education Student Advisory Board, I (together with my parent or guardian, if I am under the age of eighteen (18) or under a legal guardianship) acknowledge that walking and running in the USI Doggie Dash is potentially a hazardous activity. I voluntarily assume all risk associated with walking and running in the USI Doggie Dash including, but not limited to: illness, injuries, death, financial loss or property damage, arising from contact with other participants, contact with other dogs, the effects of the weather including cold temperatures, rain and/or snow and the conditions of the roads, and all other risks associated with participating in the USI Doggie Dash. I understand and agree that I should not enter or participate unless I am medically able and properly trained. I agree to abide by a decision of the event organizer or USI Public Safety to my ability to safely complete the walk or run. 

In addition to my safety regarding participation in the walk or run, I also understand and agree that the safety of my dog also is my sole responsibility and not that of the event organizer (Pott College of Science, Engineering, and Education Student Advisory Board) or sponsors. I voluntarily assume all risks associated with walking and running my dog on the course and among other dogs, including but not limited to: injury to the dog on the walking and running route, injury from contact with other dogs or bites and all other risks associated in participating in the USI Doggie Dash. I understand and agree that my dog must be kept on a leash and under my control at all times and that I am required to clean up after my dog (bags will be available during check-in). In addition, I am acknowledging that my dog(s) immunizations are up-to-date, and I can provide proof of such immunizations upon request. 

Knowing these facts, and in consideration of USI’s acceptance of my entry, I hereby for myself, my heirs, executors, administrators or anyone else who might claim in my behalf, covenant not to sue, and waive, release and discharge the University of Southern Indiana, its trustees, employees, and agents, all sponsors, the State of Indiana, City of Evansville, Vanderburgh County, race officials and volunteers, from any and all claims of liability for death, personal injury or property damage of any kind or nature whatsoever arising out of, or in the course of my participation in this event. 

I understand that I may be asked to leave the event if, in the sole opinion of the organizers or a Public Safety officer, I or my dog pose a threat to other participants (including other dogs), or if I or my dog are disruptive of the event and I agree that I will comply with any such request. Knowing these facts and in consideration USI’s acceptance of my entry and my or my child’s participation in the event, I hereby, now and forever release USI (…, collectively “USI”) from and against any causes of action, claims or demands of any nature that may result from or be connected in any way to my or my child’s participation in this event (“Claims”). I further agree not to sue and agree to indemnify and hold harmless the indemnitees from any Claims. It is also my express intent that that this release shall bind my spouse, family members, heirs, guardians, legal representatives and assigns. 

This release and waiver extends to all claims of every kind or nature whatsoever, foreseen or unforeseen, known or unknown. The undersigned further grants full permission to the University of Southern Indiana, the Pott College of Science, Engineering, and Education, all sponsors and/or agents authorized by them, to use any photographs, video tapes, motion pictures, recordings or any other record of this event for any purpose. Application for minors’ participation will be accepted only with parent’s signature.
