RELEASE, INDEMNITY AND ASSUMPTION OF RISK   I intend to participate in the Boise River Boogie Race (“Activities”) hosted by the Boise River Enhancement Network as a competitor, volunteer, or staff member. In consideration for being allowed to participate in the Activities, I hereby agree that I, my assignees, heirs, guardians, and legal representatives, release from all liability and promise not to sue the Boise River Enhancement Network, or any of its affiliated organizations, or either of their officers or directors collectively or individually, or the supplier of any materials or equipment that is used for the Activities, or any of the volunteer workers, for the injury or death to me, damage to my property or other loss incurred by me, however caused, arising from my participation in the Activities. Without limiting the generality of the foregoing, I hereby waive and release any rights, actions, or causes of action, both present and future, resulting from personal injury or death to me, damage to my property or other loss incurred by me, sustained in connection with my participation in the Activities. This includes any and all claims of the Boise River Enhancement Network’s negligence. If signing as a volunteer, I understand as a volunteer that I will not be paid for my services, that I will not be covered by any medical or other insurance coverage provided by the Boise River Enhancement Network, and that I will not be eligible for any workers compensation benefits. I understand I am participating in the Activities entirely at my own risk. I am aware that there are certain inherent risks associated with the Activities and may involve a test of a person’s physical and mental limits and may carry with it the potential for death, serious injury and property loss. The risks may include, but are not limited to, those caused by terrain, facilities, temperature, weather, lack of hydration, condition of participants, equipment, vehicular traffic and actions of others, including but not limited to, participants, volunteers, spectators, coaches, monitors, and/or producers of the Activities. I assume full responsibility for personal injury to myself and any property and further release and discharge the Boise River Enhancement Network from injury, loss or damage arising out of my participation in the Activities. I agree to indemnify the Boise River Enhancement Network for any harm or damage incurred by the Boise River Enhancement Network as a result of my participation in the Activities. I further agree to reimburse the Boise River Enhancement Network for all court costs and attorney fees incurred by the Boise River Enhancement Network in defending any action resulting from my participation in the Activities. I agree and acknowledge that I am under no pressure or duress to sign the Release and that I have been given a reasonable opportunity to review it before signing. I further agree and acknowledge that I am free to have my own legal counsel review this Agreement if I so desire. This Release and each of its terms are the product of an arms’ length negotiation between the parties. In the event any ambiguity is found to exist in the interpretation of this Agreement, or any of its provisions, the parties, and each of them explicitly reject the application of any legal or equitable rule of interpretation which would lead to a construction either “for” or “against” a particular party based upon their status as the drafter of a specific term, language, or provision given rise to such ambiguity. The invalidity or unenforceability of any provision of this Release, whether standing alone or as applied to a particular occurrence or circumstance, shall not affect the validity or enforceability of any other provision of this Release or any other application of such provision, as the case may be, and such invalid or unenforceable provision shall be deemed not to be a part of this Release.  I ACKNOWLEDGE THAT I HAVE CAREFULLY READ THIS “RELEASE, INDEMNITY AND ASSUMPTION OF RISK” AND FULLY UNDERSTAND THAT IT IS: A) A RELEASE OF LIABILITY; B) PROMISE NOT TO SUE THE BOISE RIVER ENHANCEMENT NETWORK AND OR ANY OTHER INDIVIDUALS AND ENTITIES ASSOCIATED; AND C) ASSUMING ALL RISKS OF PARTICIPATING IN THESE ACTIVITIES, INCLUDING TRAVEL TO, FROM AND DURING THE ACTIVITIES. PHOTOGRAPHY I further consent to the unrestricted use by the Boise River Enhancement Network and/or person(s) authorized by it of any photographs, recordings, interviews, videotapes, motion pictures, or similar visual recording of me created in the course of my participation in the Activities.
