I declare for myself /
minor/incapacitated person for whom I am parent/legal guardian: Ruby-Ann’s Run
(Event) is a test of a person's physical/mental limits and I attest I am
healthy enough to participate. I assume all Event risks, including but not limited
to falls, participant contact, severe weather, and high heat/humidity. For
myself, my executors, administrators, heirs, next of kin, successors and
assigns, and anyone who may sue on my behalf, I HEREBY WAIVE, RELEASE, and
FOREVER DISCHARGE, COVENANT and AGREE NOT TO SUE (and will INDEMNIFY if I
breach this covenant not to sue): Ruby-Ann’s Run to Remember, Event volunteers,
Event sponsors (together with parent, subsidiary or related entities), the City
of Waverly, Kansas, and the trustees, officers, directors, employees, or agents
of all of the above (collectively, Released Parties), from any claims, damages,
and liabilities of all kinds (Claims), for death, personal injury, or property
damage, arising out of, resulting from, or relating to my Event participation,
including but not limited to any Claims for theft, damage to property,
negligence, disability, claims relating to first aid, medical care, medical
treatment, or medical decisions (at the Event site or elsewhere), and any
claims for medical expenses, even if incurred as the result of negligence,
action or inaction by the Released Parties.
The parent/legal guardian who signs this Waiver for a
minor/incapacitated person (Said Person), hereby acknowledges that they have
legal capacity and authority to bind Said Person to this Waiver; and such
parent/legal guardian shall indemnify and hold harmless the Released Parties
for any expenses incurred, claims made, or liabilities assessed as a result of
any lack of legal capacity or authority to act for Said Person.
