WAIVER: I know that running in a foot race is a potentially hazardous activity. I represent, for myself and any underage child or incapacitated adult for whom I am registering that I (he or she) is properly trained and medically able to run the race. I agree to abide by any and all decisions of race officials in connection with my participation in the race and with any rules for the event. I assume all risks associated with running participants, the effects of weather, such as high heat and humidity or extreme cold, traffic and conditions of the road, and all such other risks associated with the event, including any risks to my health and well-being. Having read this waiver, I, for myself and anyone entitled to act on my behalf, waive and release March of Dimes Foundation and all other persons associated with the event, including the City of Evansville, any sponsors of the event, and rescue or medical personnel, and all their employees, volunteers, representatives and successors from all claims or liabilities of any kind arising out of my participation in this event.<br>I grant permission to March of Dimes Foundation, the City of Evansville, and any sponsors of the event, to use any photographs, motion pictures, recordings or other record of this event for any legitimate purpose, without compensation.<br>If you are registering a child under the age of 18 or an incapacitated adult you represent and warrant that you are the parent or legal guardian of that party and have the legal authority to enter into this agreement on their behalf and by proceeding with this event registration, you agree that the terms of this Agreement and Waiver shall apply equally to all such parties for whom you are registering. By registering a child under 13, you agree and consent to the collection of that child's information which you provide for the purposes of registration.<br>BY INDICATING YOUR ACCEPTANCE OF THIS AGREEEMENT AND WAIVER, YOU ARE AFFIRMING &nbsp;THAT YOU HAVE READ AND UNDERSTAND THIS AGREEMENT AND WAIVER AND FULLY UNDERSTAND ITS TERMS. &nbsp;YOU UNDERSTAND THAT YOU ARE GIVING UP SUBSTANTIAL RIGHTS, INCLUDING THE RIGHT TO SUE MARCH OF DIMES FOUNDATION AND ALL OTHER PERSONS ASSOCIATED WITH THE EVENT, INCLUDING THE CITY OF EVANSVILLE, ANY&nbsp;SPONSORS AND RESCUE OR MEDICAL PERSONNEL, AND ALL THEIR &nbsp;EMPLOYEES, VOLUNTEERS, REPRESENTATIVES AND SUCCESSORS. &nbsp;YOU ACKNOWLEDGE THAT YOU ARE SIGNING THE AGREEMENT AND WAIVER FREELY AND VOLUNTARILY, AND INTEND BY YOUR ACCEPTANCE TO BE A COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILITY TO THE GREATEST EXTENT ALLOWED BY LAW.&nbsp;&nbsp;<br><br>
