WAIVER AND RELEASE FORM: For and in consideration of the acceptance of my entry in the 2017 Mercedes-Benz Stadium 5K / Walk Like MADD, and all associated events. I attest that I am physically fit, have sufficiently trained for and am mentally and physically capable of participating in this road race event. My participation is voluntary and is done at my own risk. I understand that participation in running events is an inherently dangerous activity and that risks of participating include, but are not limited to, death and serious bodily injury. I assume all risks associated with participating in this event including, but not limited to, the weather, to include high heat and humidity, conditions of the road and other race area surfaces, falls, collisions, motor vehicle traffic, and the conduct of spectators and other runners. I hereby, for my myself, my heirs, my administrators and executors, personal representative and my assigns forever waive, release and discharge any and all rights and claims for damages or losses, whether monetary or otherwise compensatory, that I may have against: (i) the Atlanta Track Club, its directors, executive director, officers, employees, members, representatives and agents: (ii) Georgia Dome (iii)Atlanta Falcons : (iv) all the 2017 Mercedes-Benz Stadium 5K / Walk Like MADD or any of its ancillary event's officials, participants, organizers, planners and volunteers (v) the City of Atlanta for any injuries sustained by me arising out of my association with, entry in, or participation in the 2017 Mercedes-Benz Stadium 5K / Walk Like MADD and any pre-, post-, or other race related activity. I understand and agree that medical or other services rendered to me by or at the instance of any of the above parties is not an admission of liability to provide or continue to provide any such services and is not a waiver by any said parties of any right hereunder. I also acknowledge that should I require transport to a medical facility, I must pay for such transportation and any treatment provided. I further agree now and forever to hold the above named and unnamed parties harmless and indemnify, and covenant not to sue them for all claims, damages, judgments, and costs of whatever nature and form. I agree to abide by all instructions from race officials and I agree to withdraw from the race if such official in his or her judgment and discretion determines that I should not participate including because my participation poses a threat to the safety of myself or because I did not abide by any instruction given to me. I understand and will abide by the rule that for safety, no wheeled vehicles or wheeled means of conveyance are permitted in the 5K. I grant permission to the Atlanta Track Club and others to use any photographs, videotapes, motion pictures, recordings or any other record of me and/or this event for any legitimate purpose. I also grant permission for the Atlanta Track Club to contact me by email for race-related communications. I understand that the race entry fees paid by or for me are nonrefundable. The no refund policy applies to any cancellation of the race for weather or other circumstances as deemed appropriate by the official race director. NUMBERS FOR THE 2017 Mercedes-Benz Stadium 5K / Walk Like MADD, One Mile Run, AND 50m Dash AND ITS ANCILLARY EVENTS ARE NOT TRANSFERABLE.
I
hereby acknowledge, agree and understand that the Walk Like MADD® event involves
walking, running and, in some instances cycling and even motorcycling – all
activities that may include risks such as, but not limited to, falls, crashes
interaction with other participants, effects of weather, traffic and conditions
of the road. In consideration of being allowed to participate in this event, I
hereby expressly assume all risks, including personal injury and death, arising
in any way out of my participation in Walk Like MADD® and related activities.
It
is my responsibility to dress appropriately including, in some instances,
wearing protective gear including a helmet. Although route maps, rest stops,
refreshments, and other assistance may be made available during this event, I
am solely responsible for my own health and safety. I represent and warrant
that I am physically fit and able to participate in this event and I agree to
stop and request assistance if I experience any symptoms such as, but not
limited to, dizziness, excessive fatigue, shortness of breath, pain or any
other conditions which would make it difficult or unsafe to continue.
I
agree, for myself, my heirs, executors and administrators, to not sue and to
release, indemnify and hold harmless, MADD, its affiliates, officers,
directors, volunteers and employees, and all sponsoring businesses and
organizations and their agents and employees, from any and all liability,
claims, demands, and causes of action whatsoever, arising out of my
participation in this event and related activities - whether it results from
the negligence of any of the above or from any other cause.
This
release and indemnification agreement shall be as broad and inclusive as is
permitted by the State or Province in which the event is conducted. If any
portion of it is held invalid, the balance shall continue in full force and
effect. I have read, understand and agree to the terms of this Agreement. If
Participant is a minor, the parent or guardian must agree to the below: I am
the legal guardian of Participant, and I hereby consent to his/her
participation.
I
understand that the registration fee is non-refundable/non-transferrable.
In
the event that I bring my pet to Walk Like MADD®, I agree to indemnify, defend
and hold MADD, its employees, volunteers, participants, and others in
attendance at the Walk Like MADD® event harmless from any damages, injuries,
liability, suits, fees, and expenses associated with any actions of my pet. My
pet and his/her behavior is solely my responsibility, and I agree to assume
full responsibility for any damages or losses caused by the same. I agree that
any pet I bring to the event will have all current vaccinations and/or shots
required for their species, and that at all times during attendance at the
event I shall keep my pet on a leash. I further understand and agree that aggressive
pets or pets that are otherwise acting in an aggressive manner are not
permitted at the event. I understand that I must leave the event if at any time
any MADD employee, agent or volunteer asks me to leave if they believe (in
their sole discretion) that I have violated these rules regarding pet
attendance at the event.
For
consideration received, I hereby give permission without restrictions to
Mothers Against Drunk Driving (MADD), its successors and assignees to use my
name, likeness, pictures and/or voice in connection with still photography, in
print materials, a promotional video or any other purpose in furtherance of
MADD's mission.
My
consent is granted with the understanding that MADD has the sole discretion to
cut and edit the film, video or voice recording of my appearance. I
specifically waive the rights of privacy, publicity or any other rights I may
have.
I AGREE THAT MADD IS NOT RESPONSIBLE FOR ANY LOSS, DAMAGE, OR
THEFT OF BICYCLES OR PERSONAL BELONGINGS THAT MAY OCCUR AS A RESULT OF
PARTICIPATION IN THIS EVENT. I HAVE READ THE FOREGOING RELEASE AND
INDEMNIFICATION AGREEMENT, AND I HEREBY AGREE TO ABIDE BY ITS TERMS. IN THE EVENT
THAT MY CHILD IS PARTICIPATING IN THIS EVENT, I HEREBY ATTEST THAT I AM HIS/HER
PARENT OR LEGAL GUARDIAN, AND THAT I HAVE AUTHORITY TO SIGN ON HIS/HER BEHALF.
