TUCSON MARATHON EVENTS PARTICIPANT WAIVER
IMPORTANT: Race numbers are NOT transferable. Additionally,
REFUNDS and/or ROLL-OVERS are NOT offered. The course closes at 1:30pm and
cut-offs will be enforced along the course (please see the website for
details). Baby jogger and/or strollers or other 'wheeled' support devices
ARE NOT allowed on the course. All participants MUST run inside of the
safety cones marking the course or risk disqualification.
In consideration of the acceptance of this entry to the Tucson
Marathon, Tucson Half Marathon and/or Tucson Marathon Relay, I hereby, for
myself and my heirs, executors and administrators, waive any and all rights,
claims and damages I may have against the sponsors, coordination groups, Pima
County, Pinal County, Town of Oro Valley, the State of Arizona, Arizona
Department of Transportation, Amphitheater Public School District, Sahuarita
Unified School District, Arizona Department of Public Safety, Pima County
Sheriff, Pinal County Sheriff, Coronado Middle School, Dreamchasers O.A.C. LLC,
USA Track & Field, and any individuals associated with said event.
Additionally, I acknowledge that none of the above are responsible for the loss
of personal items nor any other form of aggravation in connection with said
event. I also give permission for the free use of my name and/or photo in any
promotional, broadcast, telecast, and/or print media account of the
event. Additionally, I understand that my name and email address will be
added to the race mailing database for the purpose of event updates throughout
the year and have the opportunity to opt-out of said list in the future.
I have read the event rules and regulations and understand that
all participants must obey the lawful order of a police and/or law enforcement
officer, and/or a volunteer, at all times during the event. The Tucson Marathon
Events, LLC suggests that all participants wear protective footwear while on
the course as glass, thorns, nails, screws and other debris on roadways and paths
can be harmful to barefoot competitors. In completing this form.
I acknowledge I have read and fully understand my own liability
and do accept the restrictions and further understand that ALL registration
fees are NON refundable and NOT transferable and that events are sometimes
cancelled due to acts and occurrences that are outside of the control of race
directors and that certain registration fees may be non-refundable in such
instances.
By indicating your acceptance, you understand, agree, warrant
and covenant as follows:
I understand that participating in this event is potentially
hazardous, and that I should not enter and participate unless I am medically
able and properly trained. In consideration of the acceptance of this
entry, I assume full and complete responsibility for any injury or accident
which may occur while I am traveling to or from the event, during the event, or
while I am on the premises of the event. I also am aware of and assume
all risks associated with participating in this event, including but not
limited to falls, contact with other participants, effect of weather, traffic
and conditions of the road. I, for myself and my heirs and executors,
hereby waive, release and forever discharge the event organizers, sponsors,
promoters and each of their agents, representatives, successors and assigns,
and all other persons associated with the event, for all of my liabilities,
claims, actions, or damages that I may have against them arising out of or in
any way connected with my participation in this event.
I understand that this waiver includes any claims, whether
caused by negligence, the action or inaction of any of the above parties, or
otherwise.
I understand that the entry fee is Non-refundable and
Non-transferable. I hereby grant full permission to any and all of the above
parties to use any photographs, videotapes, motion pictures, website images,
recordings or any other record of this event.
Severability: You further expressly agree that this Agreement
and Waiver is intended to be as broad and inclusive as is permitted by the law
of the State of Arizona and that if any provision of this Agreement and Waiver
shall be found to be unlawful, void, or for any reason unenforceable, then that
provision shall be deemed severable from this Agreement and Waiver and shall
not affect the validity and enforceability of any remaining provisions.
BY INDICATING YOUR ACCEPTANCE OF THIS AGREEMENT AND WAIVER, YOU
ARE AFFIRMING THAT YOU HAVE READ AND UNDERSTAND THIS AGREEMENT AND WAIVER AND
FULLY UNDERSTAND ITS TERMS. YOU UNDERSTAND THAT YOU ARE GIVING UP
SUBSTANTIAL RIGHTS, INCLUDING THE RIGHT TO SUE. YOU ACKNOWLEDGE THAT YOU
ARE SIGNING THE AGREEMENT AND WAIVER FREELY AND VOLUNTARILY, AND INTEND BY YOUR
ACCEPTANCE TO BE A COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILITY TO THE
GREATEST EXTENT ALLOWED BY LAW.
REGISTRATION:
Registrations will be accepted on-line (until 6pm on 12/6/17) and then
in-person during the pre-race Expo. On-site registration will take place on
Thursday, December 7 and Friday, December 8, at the Tucson Marathon Expo at the
Hilton El Conquistador Resort. Please see the website for exact details.
