I have read this waiver and release (“Release”) and voluntarily agree
to its terms by signing below, I acknowledge this Release is binding on
me, my heirs and assigns.
By signing this Release, I hereby
acknowledge it is my wish to participate in the HBI Radio MN Beer Run 5k
race (“Event”). I hereby attest that I am at least 21 years of age or
older.
I understand that my participation in the Event is potentially
hazardous, and that I should not enter or participate in it unless I am
medically able and properly trained to do so. I understand that
participation in this Event may result in serious injury or even death,
and in loss or damage to property, and I voluntarily accept and assume
all risks associated with my participation in this Event. Intending to
be legally bound for myself and my heirs, successors, executors,
administrators, representatives, assigns, and anyone else who might
assert any claim on my behalf, and I hereby waive, release, discharge,
and covenant not to sue KSTP-AM, LLC, KSPT-FM, LLC, KTMY-FM, LLC,
Hubbard Radio, LLC, HBI Radio, LLC, the City of Minneapolis, and all
individuals and entities associated with them, including but not limited
to their owners, officers, directors, employees, volunteers,
contractors, subcontractors, officials, and sponsors, together with
their agents, assigns, and anyone acting on their behalf, of and from
any and all claims, demands, injuries, actions, causes of action, and
liabilities, including claims of ordinary negligence, for death, injury,
or property loss or damage of any kind or nature arising out of or in
connection with my participation in this Event (collectively “claims”). I
agree that this waiver extends to all claims of whatever kind or
nature, foreseen or unforeseen, known or unknown.
I understand that
this Event is held on public streets and related facilities, and that my
health and safety may be affected by the condition of the streets and
related facilities, the actions of other participants, volunteers, race
officials, members of the public, and others, the weather (including but
not limited to heat, cold, storms, ice, snow, water, wind,
precipitation, and humidity), traffic, and other factors.
I
understand that race officials may limit my participation in this event
by cancellation, removal, or otherwise, based on their assessment of my
ability to participate in safety, my actions, the actions of others, or
other conditions, and I agree to abide by their instructions and
decisions.
I understand and agree that my registration is
non-refundable, even if this event is postponed or canceled, and that my
registration and number are not transferable.
I agree to obey and
accept all applicable rules and regulations governing my participation
in this event, and to obey and accept all directions of and from all
race and other officials relating to those rules and regulations. I
understand that if I violate any of those rules and regulations, or if I
disobey any of those directions, I may be disqualified from this event,
may forfeit any prizes that I may otherwise have won, and may be
subject to additional sanctions.
I understand that if I choose to
wear headphones, earbuds, or any other head or ear appliance or device,
that use may constitute negligence on my part, and may nullify medical
or liability insurance coverage that might otherwise be available to me,
in the event of an otherwise coverable occurrence arising out of or in
connection with my participation in this event.
If, in the opinion of
authorized medical personnel, I require medical attention or care as a
result of or in connection with my participation in this event, I hereby
grant and give my consent and permission to all authorized medical
personnel to provide any and all such attention and care as they deem
necessary or appropriate.
I attest that I am physically fit and have
properly trained for this event. I agree that if there is any question
as to my fitness, I will consult with a medical doctor before
participating in this event, and will participate only if and to the
extent that my doctor recommends that I do so.
I also grant
permission to the KSTP-AM, LLC, KSPT-FM, LLC, KTMY-FM, LLC, Hubbard
Radio, LLC, HBI Radio, LLC, and/or any agents acting on its behalf to
take and use any broadcasts, telecasts, photographs, videotapes, motion
pictures, voice recordings, and any other images or recordings of my
participation in this event for any legitimate purpose, without
compensation to me. I agree that KSTP-AM, LLC, KSPT-FM, LLC, KTMY-FM,
LLC, Hubbard Radio, LLC, HBI Radio, LLC, the City of Minneapolis, and/or
its agents may use my name in association with any such purpose, and
that all such broadcasts, telecasts, photographs, videotapes, motion
pictures, voice recordings, and other recordings, and all programs,
publications, and other products using them, are and shall remain the
property of KSTP-AM, LLC, KSPT-FM, LLC, KTMY-FM, LLC, Hubbard Radio,
LLC, HBI Radio, LLC.
