SARAH BONWELL HUDGINS FOUNDATION, INC. RELEASE AND WAIVER OF LIABILITY
This Release and Waiver of Liability (the "Release") is legally binding. If you require clarification on any aspect of this Release, please consult an attorney of your choice. IN SIGNING THIS RELEASE, YOU ARE WAIVING THE RIGHT TO BRING ANY ACTION TO RECOVER COMPENSATION OR OBTAIN ANY REMEDY FOR ANY PERSONAL INJURIES, DAMAGE TO PROPERTY, ACCIDENT OF ANY KIND (INCLUDING DEATH), THAT MAY OCCUR WHEN YOU PARTICIPATE IN ANY ACTIVITIES SPONSORED AND EXECUTED BY SARAH BONWELL HUDGINS FOUNDATION, INC.
The undersigned participant (“you”) desires to participate in the “Fun Run/Walk” activities hosted by Sarah Bonwell Hudgins Foundation, Inc. on October 23, 2016. The “Fun Run/Walk” will take place on the public roads of Hampton, Virginia and on and through the campus of Thomas Nelson Community College, a public institution of higher education located in Hampton, Va. (“the College”). Participants understand that injury and/or death is possible while participating in the activities that are associated with the Fun Run/Walk.
Waiver and Release: I, (from here forward noted as “the participant”), release, forever discharge, indemnify and hold harmless, and waive any and all possible liability, claims, demands, and suits of whatever kind or nature, either in equity or law, and any and all costs, expenses, losses, medical fees and expenses, attorney’s fees, or other related causes of action for damages against Sarah Bonwell Hudgins Foundation, Inc. and the College, the Virginia Community College System (“VCCS”), the Commonwealth of Virginia, including each party’s officers, employees, and agents, and its successors and assigns, including but not limited to such claims that may result from my injury or death during or arising in any way from my participation in the Fun Run/Walk, unless any such personal injury, damage to or loss of my property is directly due to the negligence of the College.
Insurance: Further I understand that Sarah Bonwell Hudgins Foundation, Inc. and the College do not assume any responsibility for or obligation to provide me with financial or other assistance, including but not limited to medical, health, or disability benefits or insurance. I expressly waive any such claim for compensation or liability on the part of Sarah Bonwell Hudgins Foundation, I nc. or the College in the event of injury or medical expenses incurred by me, the participant.

Medical Treatment: I hereby release and forever discharge Sarah Bonwell Hudgins Foundation, Inc. and the College from any claim whatsoever which arises or may hereafter arise on account of any first-aid treatment or other medical services rendered in connection with an emergency during the time of participation in the Fun Run/Walk.

Assumption of Risk: I understand that the Fun/Run Walk I am participating in includes activities that may be rigorous physical activity. As a participant, I hereby expressly assume risk of injury or harm from these activities and release Sarah Bonwell Hudgins Foundation, Inc. and the College from all liability, unless any such personal injury, damage to or loss of my property is directly due to the negligence of the College.

Photographic Release: I grant and convey to Sarah Bonwell Hudgins Foundation, Inc. and the College all right, title, and interests in any and all photographs, images, video, or audio recordings of me or my likeness or voice made in connection with my participation in the Fun Run/Walk.

Other: As a participant in the Fun Run/Walk, I expressly agree that this Release is intended to be as broad and inclusive as permitted by the laws of the Commonwealth of Virginia and that this Release shall be governed by and interpreted in accordance with the laws of the Commonwealth of Virginia. I agree that in the event that any clause or provision of this Release is deemed invalid, the enforceability of the remaining provisions of this Release shall not be affected. This Release shall be binding upon me and my assigns, heirs, representatives, executors, guardians and administrators. I understand that the College is not a host or sponsor of this event and is not responsible for the execution of this event.

IN SIGNING THIS RELEASE, I AFFIRM THAT I AM OVER THE AGE OF 18 YEARS, I AFFIRM THAT I HAVE READ THIS RELEASE IN ITS ENTIRETY. I UNDERSTAND THAT BY SIGNING THIS RELEASE I AM VOLUNTARILY GIVING UP ANY RIGHT I MIGHT HAVE TO SUE OR MAKE A CLAIM WHICH I MIGHT HAVE OR WHICH MIGHT SUBSEQUENTLY ARISE OR OCCUR IN CONNECTION WITH THE PARTICIPATION IN THE FUN/RUN WALK WITH SARAH BONWELL HUDGINS FOUNDATION, INC. AND WHICH RIGHTS MAY BE SUBSTANTIAL. I ALSO AFFIRM THAT ALL MY QUESTIONS CONCERNING THIS RELEASE AND THE SERVICES HAVE BEEN ANSWERED TO MY SATISFACTION.
