I, for myself and anyone entitled to act on my behalf, waive and release the Fort Myers Track Club, The State of Florida, the County of Lee, the City of Ft Myers, Around the Clock Fitness, Hooters of America, Inc., Hooters of Ft Myers, Edison Mall Business Trust, Simon Property Group and all sponsors and officers, directors, and members of each of said organizations, their respective employees and agents, and any other entities and individuals who are in any way connected with this event though that liability may arise out of negligence or carelessness on part of persons named in this waiver.

I grant full permission for organizers to use my name, likeness, or voice and photographs, videotapes, or quotations from me in accounts and promotions in any medium of this event, and of the activities of The Fort Myers Track Club. This permission is perpetual and worldwide.

If the event is cancelled for any reason or I am denied entry due to my falsification of any information or due to my failure to pick-up my race number and chip prior to the race, I hereby donate my entry fee to the event host. I acknowledge that this waiver will be used by the event hosts and that it will govern my actions and responsibilities at this event and shall be construed broadly to provide a release and waiver to the maximum extent permissible under applicable law. For the safety and enjoyment of all, the course is restricted to registered participants and race officials only. Unregistered participants, unauthorized vehicles, skateboards, roller-skates, baby/joggers and dogs are strictly prohibited. For your own safety, we discourage the use of radio/recorder headphones. The risk of running in high temperature and humidity is inherent to Florida activities. Be sure to drink plenty of fluids before the start of the event and remember to replace your fluids on the course and after the finish.

I hereby certify that I have read this entire contract; and, I understand its content without exception. If any provision of this waiver shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from this waiver and shall not affect the validity and enforceability of any remaining provisions.

I acknowledge that registration fees are non-transferrable and *non-refundable.
