Waiver and Release   I, the undersigned participant (and/or my parent or guardian if I am younger than 18 years of age) (the “Releasor”), agree to hold harmless, to the maximum extent permitted by law, all persons, organizations, and other individuals associated with the event, including but not limited to Sentara Healthcare and its affiliates (“Sentara”), the City of Virginia Beach, Live Nation Entertainment, Inc., Veterans United Home Loans Amphitheater at Virginia Beach, J&A Racing Inc., and each of the foregoing entities affiliates,  shareholders, members, directors, officers, employees and agents (collectively, “Releasees”), from any and all losses, costs, damages, claims, demands, rights, and causes of action of whatever kind or nature, including any and all negligence claims or causes of action that may arise or result from personal injury, property damage, death, or any other damages or injuries arising from or relating to my involvement  with the Sentara Princess Anne Hospital / Colorectal Cancer Event (the “Event”) and use of the property where the Event is held (the “Property”) and any property or amenities thereon, whether or not caused by any act or omission of a Releasee.  TO THE FULLEST EXTENT OF THE LAW, RELEASOR AGREES THAT RELEASEES SHALL BEAR NO LIABILITY FOR PERSONAL INJURY, PROPERTY DAMAGE, DAMAGES, INCLUDING, WITHOUT LIMITATION,  CONSEQUENTIAL DAMAGES arising from or relating to Releasor’s  participation in the Event or use of the Property, regardless of the theory of liability.  Releasor, for herself or himself and on behalf of his or her heirs, assigns, personal representatives and/or next of kin, forever waiveS, releaseS, dischargeS and covenantS not to sue the RELEASEES, with respect to any suits, claims, or loss and all injury, disability, death and/or loss or damage to person or property. Releasees hereby expressly and conspicuously disclaim any and all warranties, whether express or implied (including the warranties of merchantability or fitness for a particular purpose), related in any way to the Event, the Property condition or any property or amenities located on the Property. Each Releasor has carefully considered all the risks of injury and death inherent in participation in the Event and use of the Property, and further agrees that he or she will not take part in any activity unless he or she fully appreciates, understands, and is aware of the nature and extent of the risks of personal injury and death inherent in such activity.  Each Releasor hereby undertakes any activity in which he or she participates voluntarily and of his own free will and certifies that the participant is physically fit and sufficiently trained to participate in this Event.   Releasor further attest that he or she will be mindful of traffic along the race course.  Consent to Use Photographs and/or Audio Visual   Releasor does hereby give permission for the use, reproduction, and/or publishing of photographs and/or video that may pertain to participant– including participant’s image, likeness and/or voice, without compensation.  Releasor understands that this material may be used in various publications, public affairs releases, fundraising materials, broadcast public service advertising (PSAs) or for other related endeavors.  This material may also appear on Sentara’s Internet Web Page www.sentara.com, Sentara’s Network and/or Sentara Healthy Edge, and may be provided to and published by various public media outlets, including, but not limited to, The Virginian-Pilot, The Daily Press, The Associated Press, WTKR TV, WVEC TV, WAVY TV and other local, regional, national and international print, broadcast and internet media. This authorization is continuous and may only be withdrawn by my specific rescission of this authorization.  Sentara may publish materials, use my name, photography and video, and/or make reference to me in any manner that Sentara deems appropriate in order to promote or publicize Sentara.   I also understand that the entry fees are nonrefundable.
