In consideration for the acceptance of my registration as a participant in the NBMS 2016 Chilly Challenge and with the understanding that my participation in this event is only on condition that I enter into this agreement, for myself, my heirs and assigns, I hereby assume the inherent and extraordinary risks involved in the race and any risks inherent in any other activities connected with this event in which I may voluntarily participate. I assume all risks associated with participating in this race including but not limited to: falls, contact with other participants, effects of weather, heat, cold or precipitation, vehicular traffic, the condition of roads or trails.  I for myself and anyone for whom I am entitled to act expressly assume the risk of and accept full responsibility for any and all injuries, including death and accidents, which may occur as a result of my participation in this event and release from liability, the race organizers, Buncombe County Schools, North Buncombe Middle School PTO, North Buncombe Middle School, Superfly Fabulous Events and each of their officers, directors and agents, representatives, employees, volunteers and members. I hereby waive any claim I may have hereafter as a result of my participation in the Chilly Challenge and in any other activities connected with this event in which I may voluntarily participate. I hereby agree to indemnify, defend, and hold harmless the race organizers, Buncombe County Schools, North Buncombe Middle School PTO, North Buncombe Middle School, Superfly Fabulous Events and each of their officers, directors and agents, representatives, employees, volunteers and members from any and all liability, loss, damage, or expense, including attorney’s fees, which arise out of, occur during, or are in any way connected with my voluntary participation in Chilly Challenge. I also consent to my removal in the event that I violate the prohibition on bikes, skates or other wheeled devices or if I in any way endanger the safety of others. I give permission for free use of my name and picture in any broadcast, telecast or written account of this event.  Race organizers reserve the right to alter, postpone or cancel the race in the interest of participant and/or public safety. I understand that the entry fee is NON-REFUNDABLE.  I give permission to use any photos from the race in future promotions or advertisements.
