I AGREE to comply with the rules, regulations, and event instructions of Hyatt Regency Maui Resort and Spa 2015 Paddle for a Cure Fundraiser for Susan G. Komen Foundation – Hawaii Affiliate (the “Event”).
I UNDERSTAND that participating in this Event is a potentially hazardous activity and can result in serious injury or death. I am aware of and I expressly assume all inherent risks associated with participating in this Event, including, but not limited to, falls, contact with other participants, and objects, the effects of weather, including high heat and humidity. I understand that this Event takes place on open ocean, and the Releasees are not responsible for controlling the inherent dangers present in ocean waters.
IN CONSIDERATION of your accepting this entry, I for myself and anyone entitled to act on my behalf, waive and release Hyatt Corporation, CCHH Maui LLC, HMC Maui LP, Event sponsors and their respective affiliates, subsidiaries, members, officers, directors, agents and employees (collectively, the “Releasees”) from any and all claims, damages, demands, rights of action, causes of action, losses, costs (including attorneys’ fees) (collectively, “Losses”), whether anticipated or unanticipated, arising out of, or in any manner resulting from my participation in the Event at Hyatt Regency Maui Resort and Spa (“Hotel”) on October 3, 2015. This includes without limitation any Losses resulting from, or arising out of the negligence of the Releasees. I hereby agree to waive any and all such Losses.
I ATTEST that I am physically able and have sufficiently trained for participation in this Event.
I ATTEST that I am 18 years of age or older.
I CONSENT to receive medical treatment which may be advisable in the event of illness or injuries suffered by me during this Event, and I agree to pay for the costs of my medical treatment.
I AGREE to receive mailings from Hyatt Regency Maui Resort and Spa, the Butterfly Effect and Maui Paddle for a Cure vendors which, does not obligate me to purchase any Event-related product.
I GRANT to Hyatt Corporation and Hyatt Regency Maui Resort and Spa (together, “Hyatt”) and their respective representatives and employees the right to take photographs, and/or video of me and/or my property, in connection with the Event. I authorize Hyatt, their assigns, licensees and transferees to copyright, use and publish my name, likeness, image, voice, and or appearance as such may be embodied in any pictures, photos, video recordings, audiotapes, digital images, and the like, taken or made in connection with the Event (hereinafter referred to as the “Images”).
I understand and agree that Hyatt shall have complete ownership of such Images, including, without limitation, all copyrights, and shall have the unlimited right to use the images without any additional approval or compensation. Such uses shall include, but are not limited to, illustrations, bulletins, exhibitions, videotapes, reprints, reproductions, publications, advertisements, and any promotional or educational materials in any medium now known or later developed, including the Internet.
I acknowledge that I shall not receive any compensation associated with the images hereby released and hold harmless Hyatt, their parents, subsidiaries, franchisees, assigns and authorized agents from any and all claims which arise out of or are in any way connected with such use.
I AGREE that the waivers and releases contained herein shall be binding on my heirs, executors, administrator and assigns.
I AGREE that I have read and understood this waiver and release.
I AGREE that electronic submission of this application constitutes
agreement to all the terms of this waiver and release statement.
